A RESOLUTION REVISING A DEVELOPMENT ORDER FOR
THE SOUTHGATE GARDENS, INC., 7300 SOUTHGATE
BOULEVARD PROJECT. DEVELOPMENT ORDER NO. 010
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, pursuant to the instructions of the City Council of the City of
g Tamarac, Florida, a public meeting has been advertised in accordance with applicabl(
9 law of the date, time and place of the meeting regarding the review of the applica-
10 tion for a development order by the applicant for development approval; and
11 WHEREAS, The City Council has examined and investigated the application,
12 staff and Planning Commission recommendations; and
13 WHEREAS, the City Council reviewed the development order and accompanying
14 documents at a public meeting; and
15 WHEREAS, the City Council has determined that the application is in compliance
16 with all elements of its Comprehensive Plan, or will be in compliance prior to the
issuance of a Certificate of Occupancy for any unit on the development that is the
subject of the application.
NO111, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
�p SECTION 1: That the application for approval of a revised Development Order
21 for Southgate Gardens, Inc. for a six (6) foot high wood shadowbox fence along the
22 south property line, is approved subject to the following conditions:
23 A. Construction is to be in complete compliance with the plans and specifica-
24 tions submitted by the developer to the City of Tamarac as described. in Section II
.25 of the Development Review Status Sheet and approved engineering drawings.
26 B . Commencement of construction shall be no longer than one year from the
27 date of this approval. If the development does not -commence construction within
28 one year, this approval is null and void unless an extension has been granted in
29 accordance with applicable regulations.
'�D C. The Development Order is assignable, but an assignment does not discharge

any assignee from strict compliance with the order unless the City Council consents
to modify any of the original requirements.

D. Additional conditions established in order to issue the development order
are set forth as follows:
1. The fence to be installed along the south and east property
lines must be maintained in good order and kept painted or
stained at all times on both sides;
2. The fence must have a clearance of 6-inches from the ground
for grass cutting and maintenance.
SECTION 2: Should any section or provision of this development order be
declared by a court of competent jurisdiction to be invalid, the City Council shall
determine if the other portions of the order remain valid or whether the approval
shall be null and void.
SECTION 3: This development order as conditioned shall become effective
inmiddi.ately upon its passage.
PASSED, ADOPTED AND APPROVED this 14th day of September 1983.
