CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-83-20
A RESOLUTION AUTHORIZING AND DIRECTING THE PROPER CITY
OFFICIALS TO :ENTER INTO AN AMENDED WATER AND SEWER
AGREEMENT FOR MAINLANDS CENTER TO CORRECT A SCRIVENER'S
ERROR; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, a Water and Sewer Agreement was properly entered into between the
CITY and the developer, STANMACA CORPORATION, on ;January 27, 198.1; and
WHEREAS, it has come to the CITY'S attention that copies of the Agreement
providing for six (6) ERC'S instead of 2.5 ERC'S were mistakenly executed
and recorded in the Public Records of Broward County; and
WHEREAS, it had been the intention of the CITY that the contract provide for
2.5 ERC'S and fees were properly collected for 2.5 ERC'S,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That the proper City Officials are authorized and
directed to enter into an Amended Water and Sewer Agreement with STANMACA
CORPORATION correcting the scrivener's error of six (6) ERC'S in the
January 27, 1981 Water and Sewer Agreement filed in Book 9667 at Pages 465
through 478 of the Public Records of Broward County. The Amended Agreement
shall provide for 2.5 ERC'S and be properly recorded after execution. -
SECTION 2: This Resolution shall become effective upon adoption.
PASSED, ADOPTED AND APPROVED this _26th day of January , 1983.
