R-83-199 A RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT WITH BILLY BOB'S, INC., FOR USE OF A PISTOL RANGE FOR MARKSMANSHIP TRAINING OF TAMARAC'S SWORN POLICE OFFICERS; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the proper City officials are hereby authorized to execute an Agreement with Billy Bob's, Inc., for use of a Pistol Range for marksmanship training of City sworn police officers at a cost of $3.50 per officer per month. Said Agreement shall be in effect from August 1, 1983 through September 30, 1984 and may be renewed by the City for an additional year under the same terms and conditions. SECTION 2: This Resolution shall become effective upon adoption. A G R E E M E N T THIS AGREEMENT made this 1st day of July, 1983, between the CITY OF TAMARAC, a municipal corporation of the State of Florida, hereinafter referred to as "CITY" and BILLY BOBS, INC., a Florida corporation, having offices at 1751 West Copans Road, Pompano Beach, Florida 33064, hereinafter referred to as "RANGE". and W I T N E S S E T H: WHEREAS, RANGE owns a firearms range open to the pubic; WHEREAS, the CITY is desirous of using the facilities of said range for the markmanship training of its police officers; NOW, THEREFORE, in consideration of the premises and the mutual undertakings and agreements herein contained and assumed, the parties hereto agree as follows: 1. That the sworn officers of the Police Department of the CITY shall have use of the firing range located at said RANGE on a prescheduled basis during the hours of operation which are 10:00 A.M. until 9:00 P.M., Monday through Thursday and 10:00 A.M. until 6:00 P.M., Friday, Saturday and Sunday. The time allotted to CITY shall be a sufficient number of days per month prudently organ- ized considering that said RANGE is a commercial venture and has pre- viously and may in the future enter into similar agreements with other municipalities. In no event shall time allotted to CITY be less than six (6) hours per week. 2. That use of the RANGE shall include the following: -1- A. Prescheduled use of the five (5) point police RANGE. B. Prescheduled use of the training room located at RANGE. C. Prescheduled use of the rifle range for shot- gun training. D. Prescheduled use of laser target system. E. RANGE shall supply all targets needed for qualification only. (Officers shall supply their own targets for practice sessions.) F. Each officer shall have unscheduled and unlimited use of the civilian pistol range by off -duty officers for practice subject to same restrictions as civilian range members. 3. That the CITY shall pay RANGE the sum of Three Dollars and Fifty Cents ($3.50) per officer per month to be paid on a monthly basis upon submittal of an invoice by RANGE to the CITY after services are rendered. 4. RANGE hereby agrees to indemnify and hold CITY harm- less from any actions of every name and description brought against the CITY for and on account of any injuries or damages received or obtained through any person by or in the consequence of any act or -2- 1 omission of said RANGE or any of its employees, agents, servants, or guests other than police officers. 5. RANGE warrants and otherwise materially represents that it currently has comprehensive liability insurance in the amount of Three Million ($3,000,000.00) Dollars to protect it and CITY from claims for damages or personal injury, including accidental death as well as from claims for property damage which may arise from the operations hereunder and that RANGE shall maintain same in full force and effect during the term of this Agreement, a certificate of insurance shall be attached hereto as EXHIBIT "A" at execution of this Agreement. 6. That the duration of this Agreement shall be from August 1, 1983 through September 30, 1984. The CITY, upon thirty (30) days written notice to said RANGE, shall have the right to renew this Agreement for an additional one (1) year period at the same payment rate as set forth in paragraph 3 above. 7. That the CITY shall have the right, upon thirty (30) days written notice to RANGE, to terminate this Agreement without additional cost or penalty.
