R- 'wr 2 --.. 3 A RESOLUTION ISSUING A DEVELOPMENT ORDER FOR A REVISED 4 SITE PLAN FOR SPRINGLAKE II - PHASE ONE PROJECT. DEVELOPMENT ORDER NO. 045; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Council. of the City of Tamarac, Florida, a public meeting has been advertised in accordance with 9 applicable law of the date, time and place of the meeting regarding the review 10 of the application for' a development order by the applicant for development u approval; and 22 WHEREAS, the City Council. has examined and investigated the application, 23 staff and Planning Commission recommendations; and 14 WHEREAS, the City Council reviewed the development order and 15 accompanying documents at a public meeting; and 16 WHEREAS, the City Council has determined. that the application for Phase I is in compliance with all elements of its Comprehensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for any unit on the development that is the subject of the application. 20 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE. CITY OF TAMARAC, 21 FLORIDA: 22 SECTION 1: That the application for approval of a revised site plan 23 for Springlake TI - Phase One, prepared by Carnahan & Associates, revised July 19, 1982, to reflect project phasing, is approved subject to the following conditions: 26 A. Construction is to be in complete compliance with the plans 27 and specifications submitted by the developer to the City of Tamarac as 28 described in Section TI of the Development Review Status Sheet dated "Revised 29 July 19 1982" for Phase I Sheet #2 and ap proved ppr.oved engineering drawings. B. Commencement of construction shall be no longer than one year i from the date of this approval. The Development order is assignable, but an'asslgnment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue the development order are set forth as follows: s 1. Wroval is only for Site plan I. This approval is not intended's or understood by city or developer to be an indication of any sort of concept plan approval, or the basis for any claim of vested rights_ Approval is granted with the understanding that a future or pending site plan for this project could conceivably be rejected by the City Muncil. r- 2. Phases 2, 3, and d are bnly shown for conceptual purposes and each phase requires site plan fees, council approval and Water and Sewer Developer Agreement. 3. SECTION 2: Should anysection or provision of this development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void.
