R-83- 159 A RESOLUTION ISSUING A REVISED DEVELOPMENT ORDER NO. 01-1 FOR A REVISED SITE PLAN FOR ASHMONT/KINGS POINT PROJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Council of the City of Tamarac, Florida, a public meeting has been advertised in accordance with applicable law of the date, time and place of the meeting regarding the review of the application for a revised development order by the applicant for development approval; and WHEREAS, the City Council has examined and investigated the application, staff and Planning Commission recommendation and the attached Development Review Status Sheet dated May 26, 1983;and WHEREAS, the City Council reviewed the development order and accompanying documents at a public meeting;and WHEREAS, the City Council has determined that the application is in compliance with all elements of its Comprehensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for any unit on the development that is the subject of the application. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA-. SECTION 1: That the application for approval of a revised site plan for Ashmont/Kings Point, revised May 25, 1983, to show a reduction of units from 299 to 290 and a change of product, is approved subject to the following conditions: A. Construction is to be in complete compliance with the plans and specifications submitted by the developer to the City of Tamarac as described in Section II of the Development Review Status Sheet and approved engineering drawings. B. Commencement of construction shall be no longer than one year from the date of this approval. If the development does not commence construction within one year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. The development order is assignable, but an assignment does, not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue the development order are set forth as follows: 1. This approval does not affect any terms or conditions of payments required under the existing Water and Sewer Developers Agreement. SECTION 2: Should any section or provision of this develop- ment order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. The changes are as follows: 1. Buildings D, E and G (three story - 36 unit buildings) will be all two bedroom units. 2. Buildings B, F, H and I reflect a change of product - pod building will be eliminated except for Building A (which will be built soon). 3. There will be 16 two story buildings on this new concept. 4. As per Stipulation #9, there will be 1 and 1/2 parking spaces per unit. 5. Exhibit D of Stipulation #9 addresses separation between buildings . 6. The new two story buildings will have the following mix: 1/1 2/1 2/2 Deluxe 2/2 (shown as 5404 and 5410 on plan) Second floor to have vaulted ceilings APPROVAL IS RECOMMENDED SUBJECT TO THE FOLLOWING: 1. All handicap spaces shall be ramped to the nearest walkway. 2. Include on final mylar the location of the new entrance waterfall. 3. Include in note regarding dumpsters that they will not be located over the water lines. !I Ll
