R-83- 142 A RESOLUTION ISSUING A DEVELOPMENT ORDER FOR A REVISED SITE PLAN FOR WOODMONT MAINTENANCE AREA. DEVELOPMENT ORDER NO. 082; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Council of the City of Tamarac, Florida, a public meeting has been adver- tised in accordance with applicable law of the date, time and place of the meeting regarding the review of the application for a development order by the applicant for development approval; and WHEREAS, the City Council has examined and investigated the application ,and staff recommendations, and the attached Development Review Status sheet dated 5/20/83; and WHEREAS, the City Council reviewed the development order and accompanying documents at a public meeting; and WHEREAS, the City Council has determined that the application is in compliance with all elements of its Comprehensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for the development that is the subject of the application. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the application for approval of a revised site plan for Woodmont Maintenance Area, prepared by Keith and Schnars, P.A., revised May 17, 1983, to show a fire hydrant, a pump shelter and an 8X28 construction office trailer, is approved subject to the following conditions: A. Construction is to be in complete compliance with the plans and specifications submitted by the developer to the City of Tamarac as described in Section II of the Development Review Status Sheet and approved engineering drawings. If the development does not commence construction within one year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. The development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the origina requirements. D. Additional conditions established in order to issue the development order are set forth as follows: 1-Applicant to provide easement at time of "as -built" plan submittal and construction bond will not be released until after the easement is submitted; 2-Applicant will provide emergency access across any unpaved rea; 3-City Attorney will determine proper method for vacating por ion of easement for pump shelter; 4--No building permit for the pump shelter will be issued unti the canal maintenance easement is resolved and the new cana maintenance easement has been properly recorded. SECTION 2: Should any section or provision of this de- velopment order be declared by a court of competent jurisdiction to be invalid, the City Council shall .-determine if the other portions of the order remain valid or whether the approval shall be null and void. SECTION 3: This development order as conditioned shall become effective immediately upon its passage. PASSED ADOPTED AND APPROVED this 25th day of May. __1983. Applicant to provide easement to City at the time of 'as built' submittal and construction bond should not be returned until after the easement is submitted. 2. Applicant should consider granting emergency access across any paved area. 3. City Attorney to determine proper method for vacating portion of easement (for pump shelter),. 4. Council approval of the pump house should be conditioned as follo s: 1. No building permit for the pump shelter should be issued until the canal maintenance easement is resolved. 2. New canal maintenance easement has been properly recorded. 1
