R-83- 62,,Z A RESOLUTION ISSUING A REVISED DEVELOPMENT ORDER NO. 021-3 FOR A REVISION TO SITE PLAN N0. 2 FOR. WOODMNT TRACTS 74/75 PROJECT: AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Council of the City of Tamarac, Florida, a public meeting has been advertised in accordance with applic- able law of the date, time and place of the meeting regarding the review of the application for a revised development order by the applicant for development approval; and WHEREAS, the City Council has examined and investigated the application, staff and Planning Commission recommendations, and the attached Development Review Status Sheet dated 5/6/83; and WHEREAS, the City Council reviewed the revised development order and accompanying documents at a public meeting; and WHEREAS, the City Council has determined that the application is in com- pliance with all elements of its C u prehensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for the development that is the subject of the application. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:, SECTION 1: That the application for approval of a revision to site plan #2 revised 4/25/83 for Woodmont Tracts 74/75 to show revision to Building A to reflect Unit 2 as being a two bedroom model unit, is approved subject to the following conditions: A. Construction is to be in complete compliance with the plans and speci- Ifications submitted by the developer to the City of Tamarac as described in Section II lof the attached Development Review Status Sheet dated 5/6/83 and approved engineering drawings. B. Commencement of construction shall be no longer than one year from (December 8, 1982, the date of approval of the final site plan. If the development does not commence construction within this time period, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. Additional conditions established in order to issue the development order are set forth as follows: SECTION 2: Should any section or provision of this development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. , SECTION 3: This development order as conditioned shall become effective immediately upon passage.
