R 82-86 A RESOLUTION APPROVING A SECOND AME aIJE<VT TO CONTRACT FOR SOLID WASTE COLLECTION AND DISPOSAL WITH BROWNING FERRIS INDUSTRIES OF FLDRIDA, INC. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the contract for Solid Waste Collection and Disposal approved by Council on September 7, 1979 and subsequently amended on July 23, 1980 by Resolution No. R-80-186, is hereby approved as amended with respect to new Subsection 1.19 of Section 1 Bulky Waste, Subsection 2.01(a) Frequency, (b) Quantity, (e) Residential Trash; Subsection 13.01 Compensation, Subsection 22.01 is hereby amended to increase the third pick up fee from $1.89 per month per unit to $2.05 per month per unit, Subsection 23.01 is repealed. SECTION 2: The appropriate City officials are hereby authorized and instructed to execute this Amendment to contract for Solid Waste Collection and Disposal with Browning Ferris Industries of Florida, Inc.. SECTION 3: This Resolution shall become effective upon adoption with rates effective as of January 1, 1982. 1PASSED ADOPTED AND APPROVED this 24th day of March, 1982. IATTEST: ASSISTANT CITY CLERK I HEREBY CERTIFY that I have approved the form and correctness of this RESOLUTION. .1. 33 34 35 36 MAYOR: DISTRICT DISTRICT DISTRICT DISTRICI RECORD OF COUNCIL -MOTE `~ 0 - AMENDMENT TO CONTRACT FOR SOLID WASTE COLLECTION AND DISPOSAL THIS AMENDMENT, dated the C,?_�_' day of19821, by and between the CITY OF TAMARAC, a municipal corporation of the State of Florida (hereinafter referred to as "City"), acting by and through its duly authorized City Council and BROWNING-FERRIS INDUSTRIES OF FLORIDA, INC., (hereinafter referred to as "Contractor"). WHEREAS, the City and Contractor are parties to that certain Contract for Solid Waste Collection and Disposal dated October 59 1979 (the "Contract"); and WHEREAS, the parties desire to amend the Contract to provide, among other things, for the weekly collection of bulky wastes (as herein defined) and to increase the contract prices to exactly reflect the recent increase in the costs for dumping; NOW, THEREFORE, in consideration of the foregoing and of the mutual covenants hereinafter set forth, the parties agree as follows: 1. Section 1 as hereby amended to add subsection 1.19 as follows: 1.19 Bulky Waste - The term "bulky waste" shall herein refer to all normal household discard items too large or heavy to be containerized, bagged or bundled properly for regular garbage and trash collections. These items include, but are not limited to, appliances, furniture, lawn care equipment, bicycles, etc. 2. Subsections (a) (b) and (e) of Subsection 2.01 are revised as follows: (a) Frequency - The Contractor shall collect garbage from places of residence within the contract collection area two (2) times per week, with collection at least three (3) days apart. In addition, the Contractor shall collect household trash plus garden and yard trash clippings and branches properly containerized or tied in bundles not exceeding five feet in length and any other domestic discards which may be reasonably hauled by pickup crews, on the same days as garbage. Bulky wastes shall be collected by the contractor on the residence's second scheduled pick-up day of each week. (The Contractor shall notify the public of the schedule of collection in a manner satisfactory to the City). The first collection per day will not be before 7:30 a.m. (b) Quantity - The Contractor shall be required to pick up all garbage, trash and bulky wastes generated from a residential unit in the Contractor's collection area, provided that same, excluding bulky waste, is properly prepared in containers or plastic bags individually holding not more than 32 gallons and weighing not more than 40 pounds, and placed for collection. (e) Residential Trash (1) Usual household trash may be placed in garbage cans or plastic bags each not exceeding 32 gallons used by the household and will be picked up in the same manner as garbage. (2) Garden and yard trash shall be collected from curbside. (3) Bulky and heavy items shall be placed by the owner or occupant at curbside on the second scheduled pick-up day of each week. Subsections (c), (d), (f), (g) and (h) remain the same. 3. Subsection 13.01 is revised as follows: 13.01 Compensation - Contractor shall be paid the following sums for all service that it provides within the City: Cost per month for curb service per unit other than condominium $4.30 Cost per month per unit condominium $2.05 The prices set forth above may be increased only to exactly reflect increased costs for dumping. This commitment is made by Contractor with full knowledge of increases in the cost of labor, materials, equipment and uncertainty as to the cost of fuel in the future. Contractor must demonstrate to the City Council that the amount of increase requested is the minimum amount that will exactly reflect the increased dumping costs. There shall be no fees or charges other than those specifically set forth in this contract. Contractor agrees for purposes of emphasis that the fees it will not seek to impose include, without limitation, drop fees and roll in -roll out fees. 4. Subsection 22.01 is hereby amended to increase the third pick up fee from $1.89 per month per unit to $2.05 per month per unit. 5. Subsection 23.01 is hereby deleted in its entirety. 6. In all other respects, the terms of the Contract are hereby ratified and confirmed.
