3 A RESOLUTION APPROVING A WAIVER TO THE SIGN
ORDINANCE REQUESTED BY WOODLANDS HOMEOWNERS
4 ASSOCIATION FOR A SIGN IN THE MEDIAN OF SAGO
PALM BOULEVARD.

WHEREAS, the Woodlands Homeowners Association has requested a waiver from
the Sign Ordinance No. 80-34 (Code Section 21) governing signs; and
8 WHEREAS, the Beautification Committee reviewed this request and has made
9 recommendation thereon; and
10 WHEREAS, the Chief Building Official reviewed said waiver.
11 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLARIDA:
12 SECTION 1: That the waiver to the Sign Ordinance requested by Woodlands
13 Homeowners Association for a permanent ground sign in the median of Sago Palm
14 Boulevard is HEREBY APPROVED.
15 SECTION 2: The conditions of the granting of this waiver are as follows:
16 a) Execution of a Hold Harmless Agreement approved by the City Attorney.
b) The City is to be named as an additional insured on a liability
insurance policy covering bodily injuries and property damage arising
out of the location and construction of the sign and associated
,0 beautification. The insurance in an amount not less than $100,000.
21 per person, $200,000. per accident, $100,000 property damage, prepaid
22 for at least five years, is to remain in effect for as long as the sign
23 remains in the median. The insurance policy or a binder is to be
'^ approved by the City Attorney prior to the issuance of any permit
for the sign. The policy is to provide that the City shall be
tQ given written notice by the insurance carrier at least forty-five
27 days prior to cancellation or termination.
28 c) If the City deems it necessary to remove the sign,for any reason,
29 the Woodlands Home -owners Association would be responsible to remove
30 the sign at its own expense. If the Association does not comply,
the City reserves the right to demolish the sign.
i d) This waiver is revocable at any time Council deems necessary, at its
sole and absolute discretion.

SECTION 3: This Resolution shall become effective upon its adoption.

HOLD HARMLESS AGREEMENT R- la)-:- G
THIS AGREEMENT entered into this 30th day of March,
1982, between the CITY OF TAMARAC, a municipal corporation of the State of
Florida, and WOODLANDS HOMEOWNERS ASSOCIATION.
W I T N E S S E T H :
WHEREAS, Section 21-11 of the Tamarac City Code authorizes
waivers to the City's sign ordinance under certain conditions; and
WHEREAS, an application for a waiver for an entrance sign
was submitted by the Woodlands Homeowners Association; and
right-of-way; and
WHEREAS, said entrance sign would be located on the public
WHEREAS, the City Council has considered the application
of the Woodlands Homeowners Association and has approved same subject to
certain conditions.
NOW, THEREFORE, in consideration of the mutual covenants
contained herein, the parties agree as follows:
1. Woodlands Homeowners Association covenants and agrees
to indemnify and hold harmless the City of Tamarac, its officers, agents and
employees for any bodily injuries that occur as a result of the placement,
location, construction or maintenance of an entrance sign located as shown in
Exhibit "A" attached hereto and incorporated herein.
2. If the City finds it necessary to remove the sign the
Woodlands Homeowners Association will remove the sign, at its own expense,.
and if the Association does not remove the sign, the City is authorized to
demolish the sign.
3. The Woodlands Homeowners Association acknowledges that
the authority to erect and maintain the sign is revocable at the will of
the Tamarac City Council.
IN WITNESS WHEREOF, the parties hereto have made and
executed this Agreement on the respective days of each signature.
