A RESOLUTION AUTHORIZING EXECUTION OF AN
AGREEMENT WITH THE FLORIDA DEPARTMENT OF
LAW ENFORCEMENT, FLORIDA INTERAGENCY
NARCOTICS INFORMATION NETWORK; AND PRO-
VIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the appropriate City officials are hereby
authorized and directed to execute an Agreement with the Florida
Department of Law Enforcement, Florida Interagency Narcotics Informa-
tion Network, a copy of said Agreement attached hereto as Exhibit "A".
SECTION 2: This Resolution shall become effective upon adoption.

REGULAR MEMBER USERS AGREEMENT
This Agreement, is entered into between the Florida Department of Law
Enforcement (hereinafter referred to as "FDLE") , an agency of the State of
Florida with headquarters at 408 North Adams Street, Tallahassee, Florida,and
the TAMARAC POLICE DEPARTMENT
with headquarters at 5811 N.W. 88th Ave., Tamarac, Broward Count Florida.
(hereinafter referred to as the user --. It is agreed that:
A. INTRODUCTION
1) In the best interests of the citizens of the State of Florida, the
FDLE, Florida Sheriffs Association and the Florida Police Chiefs
Association entered into an agreement, on 2/29/80 establishing the
Florida Interagency Narcotics Information Network (hereinafter re-
ferred to as FININ.)
2) FININ shall serve as a central repository and "pointer index" for
information related to major narcotics law violators operating in the
State of Florida.
3) FININ, specifically will limit its area of concern to:
a. Narcotics Smuggling/Trafficking
b. Alien Smuggling related to narcotics trafficking
C. Weapons/Narcotics Trade
4) The primary objective of FININ is to assist local and state narcotics
enforcement agencies in enforcing violations of the drug laws and
combating illegal narcotics trafficking through the coordination of
information and enforcement activities; however, FININ will not
function as an operational narcotics enforcement unit.
B. FDLE AGREES TO:
5) Establish a responsible system for the meaningful exchange of
narcotics trafficker information among user agencies.
6) Supply policy and procedures and membership applications which shall
be reviewed and approved by the FININ Advisory Board comprised of
three (3) sheriffs and three (3) chiefs of police.
7) Insure that all employees assigned to the maintenance of the FININ
central index and the interface with El Paso Intelligence Center are
cognizant of the potential damage unauthorized release of information
might incur upon agencies and to an individual's right to privacy.
FININ central index information shall be disseminated only in com-
pliance with procedures established by FDLE with the advice of
the FININ Advisory Board.
8) Report to the FININ Advisory Board any information received
pertaining to alleged violations of the security and dissemination
policy and procedures relating to the operation of the system.
9) Establish criteria for the continuous re-evaluation of the data con-
tained in the index, including measures for purging the index of
data which is determined to be inaccurate, outdated, or otherwise no
longer relevant to the FININ objective.
10) Provide a central point of contact for user access to the El Paso
Intelligence Center (EPIC) which contains U.S. Government Agency
information on narcotics traffickers, and narcotics related data on
aircraft, vessels and businesses.
C. THE "USER" AGREES TO:
11) Assume responsibility for restricting the use of FININ data to law
enforcement purposes.
12) Access the index through approved agency representatives in
accordance with established policy and procedures, and require that
other users provide and maintain security and privacy procedures
consistent with FININ standards as a necessary condition for access
to index information.
13) Make a continuous effort to insure that information submitted to the
FININ index concerning narcotics law violators is collected and main-
tained only if grounds exist connecting the named individual with
known or suspected criminal activity and the information submitted
is relevant to that criminal activity.
14) Make a continuous effort to submit narcotics information and to insure
the completeness, accuracy and veracity of the information submitted to
the FININ index.
15) Insure that sensitive data received from other FININ members is
provided maximum security and that all data is given appropriate
protection, and disseminated only to governmental agencies involved
in the identification, investigation, or prosecution of narcotics law
violations.
16) Submit to FININ information on the appropriate information sub-
mission forms distributed by the FDLE staff or by other methods
promulgated by FDLE with the advice of the FININ Advisory Board,
or promulgated by subsequent policies and procedures.
17) Assume all responsibility for any use or misuse of information re-
ceived from FININ, and hold FDLE harmless for any use or misuse
of information received from FININ.

18) Comply with the policies and procedures promulgated b
the advice of the FININ Advisory Board and to insure
of the FININ and EPIC systems and to protect against
intrusions into private lives of innocent persons. It
duty of all FININ member agencies and personnel to
violations of FININ policies and procedures to FDLE.

19) The FDLE reserves the right to discontinue the dissemination of
narcotics information to a member agency when either security or
the dissemination requirements promulgated by FDLE with the advice
of the FININ Advisory Board are violated. Upon taking such action
the Chairman of the FININ Advisory Board shall be notified immedi-
ately by FDLE.
20) The FININ Advisory Board shall at its next meeting review alleged
violations of security or dissemination requirements and by a unani-
mous vote of the Board approve either reinstatement, continued
suspension, or expulsion of the member agency from the FININ
system. FDLE may reinstate the furnishing of narcotics information
in such instance upon receipt of satisfactory assurances that such
violation has been corrected.
This agreement will become effective upon approval and signature by the
Agency Head and the Executive Director of the Florida Department of Law
Enforcement and the Administrator of the Florida Interagency Narcotics Infor-
mation Network.
