CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-82-33/
A RESOLUTION APPROVING AND ACCEPTING A
UTILITY EASEMENT FOR A FIRE HYDRANT
OFFERED BY HOWARD R. SWANSON FOR THE
SWANSON WEST PROJECT; AND PROVIDING AN
EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the Utility Easement for a fire hydrant
offered by Howard R. Swanson for the Swanson West project is hereby
approved and accepted, a copy of said easement being attached hereto
as Exhibit "A".
SECTION 2: That the City Clerk is hereby authorized and
directed to record said easement in the Public Records of Broward
County, Florida.
SECTION 3: This Resolution shall become effective upon adop-
tion.
PASSED, ADOPTED AND APPROVED thisday of 1982.

GRANT OF EASEMENT
STATE OF FLORIDA
COUNTY OF BROWARD
THIS INDENTURE made and entered into on the27th day
of SEPTEMBER 1982, by and between HOWARD R. SWANSON, of the
County of Broward, State of Florida, GRANTOR; and the CITY OF TAMARAC,
a Municipal Charter corporation, of the County of Broward, State of
Florida, GRANTEE;
WHEREAS, the Grantor is seized in fee simple and is in
possession of lands more particularly described in Exhibit "A" attached
hereto and entitled Utility Easement.
WHEREAS, the Grantor has agree in consideration of
the Grantee's granting unto the Grantor the right to construct a
structure on land contiguous to the easements, and to maintain service,
and repair the fire hydrant, and its related water pipes and mechanicals
and for other good and valuable consideration to grant to the Grantee
and all other persons claiming by, through or under the Grantor, his
predecessor in title, or his heirs, assigns or legal representatives
by virture of any deeds of conveyances as to lands more specifically
described as Lot 8, Block 7, LYONS COMMERCIAL SUBDIVISION, according
to the Plat thereof, as recorded in Plat Book 69 at Page 42, of the
Public Records of Broward County, Florida, said lands lying, situate
and being in the City of Tamarac, Broward County, Florida, an easement
or right of way over the land described below for the purposes and in
the manner expressed below.
NOW THIS INDENTURE WITNESSETH:
That, in pursuance of this Agreement and for the
consideration described above and other good and valuable consideration,
Grantor grants unto Grantee, its heirs and assigns, and to all other
likely situated as above described,,and their heirs and assigns;
Full and free right and liberty for them and their
servants, agents and licensee and in common with all persons having the
like right, at all times hereafter, a utility easement over, upon and
under the land described in the attached Exhibit "A". Said easement
for the purpose of maintaining, repairing, servicing, replacing and
otherwise doing all things necessary and incident to the maintaining
of a fire hydrant within the legal description attached hereto as
Exhibit "A", and for such other purposes as are incident and necessary
thereto.
TO HAVE AND TO HOLD the easement or right-of-way
hereby granted unto the Grantee, its assigns, and those likely situated
as described above, as appurtenant to the land of the Grantee and those
likely situated.
It is understood that the easement is given upon the
express understanding and condition that it may be used by the Grantor,
his heirs, executors, administrators, assigns, successor in title,
mortgagees, tenants and such other persons as may be entitled to use
this land by, through and under the Grantor and others likely situated.
It is further understood that the Grantor will install
this fire hydrant, water line, and related items necessary to make a
functional fire hydrant in accordance with the plans and specifications
submitted and approved by the Grantee and thereupon after installation
and operation of this fire hydrant the Grantee will have no further
responsibility to improve, maintain, service, repair or replace this
fire hydrant.
IN WITNESS WHEREOF, Grantor has set his hand and seal
on the day and year first above written.

to be the person described in and who executed the foregoing
Bill of Sale, and he acknowledged before me that he executed
