R-82- 330 A RESOLUTION APPROVING AND ACCEPTING AN ACCESS EASEMENT FOR INGRESS/EGRESS OFFERED BY HOWARD R. SWANSON FOR THE SWANSON WEST PROJECT; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the Access Easement for ingress/egress offered by Howard R. Swanson for the Swanson West Project is hereby approved and accepted, a copy of said easement being attached hereto as Exhibit "A". SECTION 2: That the City Clerk is hereby authorized and directed to record said easement in the Public Records of Broward County, Florida. SECTION 3: This Resolution shall become effective upon adop- tion. SWANSON, of the County of Broward, State of Florida, GRANTOR; and the CITY OF TAMARAC, a Municipal Charter corporation, of the County of Broward, State of Florida, GRANTEE; WHEREAS, th6 Grantor is seized in fee simple and is in possession of lands more particularly described in Exhibit "A" attached hereto and entitled Access Easement.. WHEREAS, there is a certain parcelof land contiguous to the East property line of the property of the Grantor; and WHEREAS it is the desire of the Grantor herein that the property immediately East and contiguous to the Grantor's property shall be entitled to an Access Easement over the land of Grantor, this Access Easement more particularly described in attached Exhibit "A". WHEREAS, the Grantor in consideration of the obtaining of certain permits for construction and utilization of Grantor's property and other good and valuable consideration to grant to Grantee and all other persons claiming by, through or under the Grantor, his predecessor in title, or his heirs, assigns or legal representatives by virtue of any deeds of conveyances as to lands more specifically described as Lot 8, Block 7, LYONS COMMERCIAL SUBDIVISION,, according to the Plat thereof, as recorded in Plat Book 69 at Page 42, of the Public Records of Broward County, Florida, said lands lying, situate and being in the City of Tamarac, Broward County, Florida, an access easement or right- cf-way over the land described in Exhibit "A", for the purposes and in the manner expressed below. NOW THIS INDENTURE WITNESSETH: That, in pursuance of this Agreement and for the consideration described above and other good and valuable consideration, Grantor grants unto Grantee, its heirs and assigns, and to all other likely situated above described, and their heirs and assigns: Full and free right and liberty for them and their tenants, servants, visitors and licensees, in commone with all persons having the like right, at all times hereafter for all purposes connected with the use and enjoyment of the land of the Grantee and those likely situated for whatever purpose the land from time to time, as may lawfully be used and enjoyed the right of access for ingress and egress across the land more particularly described in Exhibit 'A". To have and to hold this Easement or right-of-way hereby granted unto Grantee, its heirs, assigns, and licensees, and those ' likely situated and every part of it. It is understood that this Access Easement is given upon the express understanding and condition that Grantor shall be in no way responsible for any damage and negligent acts which result from the use of this access by the Grantee, such negligence and damage shall be the sole responsibility of the Grantee and those deriving the benefit and the use of this access by and through`- the Grantee.
