R-82-_3,?_-5 3 4 A RESOLUTION ISSUING A DEVELOPMENT ORDER FOR A REVISED SITE PLAN FOR THE BURGER KING RES- 5 TAURANT PROJECT. DEVELOPMENT ORDER NO. b58 AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Council of 8 the City of Tamarac, Florida, a public meeting has been advertised im accordance with applicable law of the date, time and place of the 9 meeting regarding the review of the application for a development 10 11 order by the applicant for development approval; and 12 WHEREAS, the City Council has examined and investigated the 13 application, staff and Planning Commission recommendations; and 14 WHEREAS, the City Council reviewed the development order and 15 accompanying documents at a public meeting; and 16 WHEREAS, the City Council has determined that the application 17 is in compliance with all elements of its Comprehensive Plan, or wil 3.8 be in compliance prior to the issuance of a Certificate of Occupancy for the development that is the subject of the application. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF 20 TAMARAC, FLORIDA: 21 22 SECTION 1: That the application for approval of a revised 23 site plan for Burger King Restaurant prepared by Jack Lee Meyer, P.E 24 revised October 10, 1982, to reflect a playground at the restaurant 25 is approved subject to the following conditions: 26 A. Construction is to be in complete compliance with the plans 27 and specifications submitted by the developer to the City of Tamarac and approved engineering drawings. 28 29 B. Commencement of construction shall be no longer than one 30 year from the date of this approval. If the development does not commence construction within one year,'this approval is null and Vol unless an extension has been granted in accordance with applicable s regulations. 33 C. The development order is assignable, but an assignment does 34 not discharge any assignee from strict compliance with the order 35 unless the City Council consents to modify any of the original 35 requirements. Additional conditions established in order to issue the development order are set forth as follows: 1. Landscaping between the wall and wheel stops will be changed to a continuous curb, with low coloring plantings such as crotons and ground covering installed in that area which will become additionally sprinklered for maintenange. SECTION 2: Should any section or provision of this development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void.
