A RESOLUTION AUTHORIZING RELEASE OF A CASH BOND
POSTED FOR WOODMONT TRACT 59 TEMPORARY PLATTING
WAIVER; ASSIGNING A PORTION TO SOUTHGATE GARDENS
EAST/MISSION LADS PARKS AND RECREATION FEES,
RELEASE OF THE BALANCE THEREOF, RELEASE OF AN
OVERPAYMENT OF PARK AND RECREATION FEES FOR
SOUTHGATE GARDENS EAST/MISSION LAKES; ACKNOWLEDGING
CANCELLATION OF CERTAIN AGREEMENTS RELATING TO _
WOODMONT TRACT 59 - TOLL DEVELOPMENT, INC.;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Toll Development, Inc. posted a $5,000.00 cash bond as security
for construction and demolition of model homes at Woodmont Tract 59 as a condition
for approval of a temporary platting waiver, and
WHEREAS, Toll Development, Inc. overpaid Park and Recreation fees and has
requested refund thereof in the amount of $2,910.00 for Southgate Gardens East/
Mission Lakes, and
WHEREAS, the terms of the License and Cash Bond Agreements offered by Toll
Development for Woodmont Tract 59 temporary platting waiver and models have been
canplied with, thereby voiding the agreements, and
WHEREAS, Toll Development Parks and Recreation is required to pay a
of fees on Southgate Gardens East/Mission Lakes in the amount of $4,820.00, and
W11ERE',AS, Toll Development, Inc. has requested that $4,820.00 be assigned
to Southgate Gardens East/Mission Lakes from the $5,000.00 cash bond posted for
Woodmont Tract 59, leaving a balance refund of $180.00.
WHEREAS, the City Council wishes to honor the requests of Toll Development,
Incorporated.
NOW, ARE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the Cash Bond and License Agreements by Toll Development,
Incorporated for Woodmont Tract 59 are hereby null and void.
SECTION 2: That $4,820.00 of the $5,000.00 cash bond posted pursuant to
Woodmont Tract 59 Cash Bond and License Agreements is hereby assigned as payment to
Southgate Gardens East/Mission Lakes recreation fees due.
SECTION 3: That the $2,910.00 overpayment posted for Parks and Recreation
fees for Southgate Gardens East/Mission Lakes is hereby released, along with a
$180.00 balance of the $5,000.00 Woodmont Tract 59 cash bond - for a total refund to
Toll Development, Inc. in the amount of $3,090.00.

adoption.
