A RESOLUTION GRANTING A TEMPORARY EXCEPTION PERMIT TO TOLL DEVELOPMENT CORP., AS CON- TRACTOR VENDEE, IN LIEU OF SATISFACTION OF THE PLATTING PREREQUISITE AS PROVIDED IN CHAPTER 20 OF THE TA11ARAC CODE OF ORDINANCES. WHEREAS, Toll Deveopment Corp. has applied for a temporary exception permit in lieu of satisfying certain platting requirements of=Chapter 20 of the Tamarac Code of Ordinances; and WHEREAS, the property involved is described as Woodmont Tract 59 (Woodmont Isle) Units 35 through 40; and WHEREAS, the property involved is owned by The City National Bank of Miami, as Trustee, of Trust No. 5003183. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF TAMARAC, FLORIDA: SECTION 1: That the following findings of fact are made pur- suant to Section 20-4 of the Tamarac Code of Ordinances regarding the development of the property involved. A. An undue hardship would be imposed if all the standards set forth in Chapter 20 were complied with and such compliance would thus be unreasonable. B. The granting of this exception would not set a precedent in any way fb.r other and unlike conditions. C. Such permit for exception would not be detrimental to the interests of the community as set forth in Chapter 20. D. The property is adequately served with water and sewer facilities and no further construction is contemplated. E. No additional road right-of-way dedications are required. F. No additional easements, including water, sewer and storm drainage, are required. rN Mr% AoAi^n+-i^— of recreational land is required under Chapter -1- Temp. Reso. #2425 Rev. 9/8/82 1 2 SECTION 2: That a temporary exception permit is hereby granted 3 to Toll Development Corp. in lieu of satisfaction of the platting 4 requirements of Chapter 20 of the Tamarac Code of Ordinances for the 5 above described property. SECTION 3: That the following conditions are hereby placed on this permit: 8 A. No final Certificate of Occupancy will be issued by the City 9 for buildings on the above described property until all platting 10 requirements are satisfied. 11 B. This exception permit is conditioned on approval of site 12 plan by City Council. 13 1. A cash bond of $5,000.00 being posted when applying for a 14 permit for Units 35 through 40 to guarantee demolition if the plat 15 has not been recorded at the County by 1/30/83; the City will use 16 the cash bond to demolish Units 35 through 40 providing the applicant 17 does not do so upon notice. ,g 2. A License for Entry to demolish must be provided to be used by the City in the event the City decides it is necessary to exercise 20 their option to demolish the units if the applicant does not do so. 21 3. All conditions listed in the Consultant City Planner's memo 22 of 9/2/82, M.F.-21-82, which are listed as follows: 23 a) Applicant to provide a Hold Harmless Agreement in form 24 acceptable to the City Attorney indemnifying the City from any poten- 25 tial fire liability occurring before the fire hydrants are properly 26 installed. 27 b) Waiver of platting is only for units 35 through 40 for models 28 and sales use only. 29 c) Units 17 through 74 (excluding 35 through 40) may not receive 30 building permits unless approved by Council. d) The developer should submit information demonstrating how the administration office will have toilet facilities. 33 e) No temporary Certificate of Occupancy to be issued until driv 34 way is paved to existing roadway. 35 4. Before the models can open to the public, there must be a 36 Paved roadway in order to reach the models. -2- Temp. There would only be a temporary Certificate of Occupancy for model and sales use. 6. The tree in the parking area will be moved to another location. SECTION 4: This Resolution shall be effective upon adoption.
