Reso. #2148 Rev. 1/27/82 1 CITY OF TAMARAC, FLORIDA 2 RESOLUTION PIO. 3 A RESOLUTION ISSUING AN AMENDED DEVELOPMENT ORDER FOR THE RICHWAY AT TAMARAC PROJECT. DEVEIAP_MENT ORDER NO. 1-81 4 REVISED: AND PROVIDING AN EFFECTIVE DATE WHEREAS, pursuant to the instructions of the City Council of the City of Tamarac, Florida, a public meeting has been advertised in accordance with applicable 7 law of the date, time and place of the meeting regarding the review of the applica- 8 tion for an amanded development order by the applicant (revised site plan approval 9 sought); and 20 WHEREAS, the City Council has examined and investigated the application, 11 staff and Planning Commission recommendations, and the attached Development Review Status Sheet dated' 1/20/82 and 32 13 WHEREAS, the City Council reviewed the development order and accompanying .24 documents at a public meeting; and 35 WHEREAS, the City Council has determined that the application is in can- 16 Pliance with all elements of its Comprehensive Plan, or will be in compliance prior .7 to the issuance of a Certificate of Occupancy for any unit on the development that s is the subject of the application. 9 Nag, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, - -'20 FLORIDA: . 21 SECTION l: That the development described on the attached development 22 review status sheet dated 1/20/82 is granted < an amended development order to 23 proceed subject to the following conditions: 24 A. Construction is to be in complete compliance with the plans and spec- 25 ifications submitted by the developer to the City of Tamarac as described in Section 26 II of the Development Review Status Sheet and approved engineering drawings. 27 B. Commencement of construction shall be no longer than -one year from the 38 date of original approval. If the development does not commence construction within 29 one year, this approval is null and void unless an extension has been granted.in 30 accordance with applicable regulations. C. The development order is assignable, but an assignment does not dis- 32 charge any assignee from strict compliance with the order unless the City Council 33 consents to modify any of the original requirements. 34 D. Additional conditions established in order to issue the development 35 order are set forth following: Temp. Site Plan submitted to Council with site plan revisions showing future driveway to Parcel A with wording acceptable to the City Attorney. 2. Landscape plans submitted to Council with site plan including additions to new area in front of garden center. 3. The top soil, landscaping and Bahia sodding on the median on 82nd Street. 4. Remove Note 12 of the Revised Site Plan and the language on Parcel "A" stating "area of future ingress and egress". 5. The handicapped parking amended on the plan to show 6 spaces. 6. This project is subject to compliance with Beautification Committee recommen- dations dated 1/25/82. 7. Extend curb across the North Driveway to prevent entrance into property; to include a "No Entrance" sign. 8. Place a 'No Right Turn" sign at the west exit on N.W. 82nd Street and remove the exit arrow from the revised site plan, extend the curb across the driveway to prevent right turn and the area adjacent to it should be bermed so as not to obstruct vision, but to prevent anyone from making a right-hand turn. 9. Relocation of any utilities shall be the developers responsibility. SECTION 2: Should any section or provision of this development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. SECTION 3: This development order as conditioned shall become effective immediately upon its final passage. PASSED, APPROVED AND ADOPTED this o27day of 1982.
