A RESOLUTION AUTHORIZING AND APPROVING A WATER SERVICE AGREEMENT WITH BROWARD COUNTY FOR SERVICE TO BROWARD COUNTY REGIONAL PUMP STATION #454 LOCATED IN LAND SECTION 13, TOWNSHIP 49 SOUTH, RANGE 41 EAST, TRACT 8; AND PROVIDING AN EFFEC- TIVE DATE. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the appropriate City officials are hereby authorized to execute a Water Service Agreement with Broward County for Service to Broward County Regional Pump Station #454 located in Land Section 13, Township 49 South, Range 41 East, Tract 8, a copy of which is attached hereto as Exhibit "A" SECTION 2: The City Clerk is hereby authorized and directed to record said Agreement in the Public Records of Broward County, Florida. SECTION 3: This Resolution shall become effective immediately upon adoption. AA,, PASSED, ADOPTED AND APPROVED this��day of 1982. MAYOR: DISTRICT CITY ATTORNEY DISTRICT DISTRICT DISTRICT RECORD OF COUNCIL VOTE 4 En r- R�; I - WATER SERVICE AGREEMENT FOR BROWARD COUNTY REGIONAL PUMP STATION #454 THIS AGREEMENT made and entered into this 13 day of January 1982, by and between the City of Tamarac, a municipal corporation of the State of Florida, hereinafter called "CITY" and Broward County, a political subdivision of the State of Florida, hereinafter called "COUNTY". W I T N E S S E T H: WHEREAS, CITY is the owner and operator of a water treatment plant, together with water distribution facilities known as "TAMARAC UTILITIES WEST WATER AND SEWER SYSTEM"; and WHEREAS, COUNTY occupies certain property in Broward County, Florida, as shown and described in EXHIBIT "A" attached hereto and made a part hereof; and all references hereinafter contained to DEVELOPER's property mean the property herein referred to; and WHEREAS, COUNTY is desirous of procuring water service from the CITY for the property described upon Exhibit "A" attached hereto and made a part hereof; and WHEREAS, the parties hereto desire to enter into an agreement setting forth the mutual understandings and undertakings regarding the furnishing of said water services by CITY to the property hereinabove referred to; and WHEREAS, the agreement and all stipulations and covenants are acknowledged to be subject to the approval of every County, Regional , State and Federal regulatory agency having jurisdiction of the subject matter of this agreement. NOW, THEREFORE, in consideration of the mutual covenants and undertakings of the parties hereto and other good and valuable considerations, the parties hereto covenant and agree subject to the above provisions of the fifth preamble each with the other as follows: 1. CITY shall have the exclusive right to furnish water to consumers within the area covered by this Agreement; and Exhibit "B", attached hereto, and made a part hereof. Said "water contribution charges" are a one-time charge for as long as the number of service units or ERC's remains the same and is to be paid to the City at the time County executes this Agreement. 11. The water rates to be charged by the CITY to the COUNTY shall be the rates now or hereafter charged to other consumers within the area of service of Tamarac Utilities. The rates being charged at the time of execution of this Agreement are set forth in Exhibit "B", attached hereto and made a part hereof, and the COUNTY acknowledges and agrees that the rates as set forth in said Exhibit are subject to change at any time by the CITY and that said new rates shall be considered as incorporated by reference and a part of this Agreement upon the CITY notifying the COUNTY of said new rates.
