R- /9 A RESOLUTION APPROVING AND ACCEPTING A 12-FOOT UTILITY EASEMENT FOR SEWER PURPOSES OFFERED BY F & R BUILDERS, INC., SAID EASEMEM LYING IN AND BEING A PORTION OF SECTION 6, TOWNSHIP 49 SOUTH, RANGE 41 EAST, FOR THE KINGS POINT PROFESSIONAL PLAZA PROJECT; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the 12-foot utility easement for sewer purposes offered by F & R Builders, Inc., said easement lying in and being a portion of Section 6, Township 49 South, Range 41 East, for the Kings Point Professional Plaza project, is hereby approved and accepted. A copy of said agreement is attached hereto as Exhibit "A". SECTION 2: The City Clerk is hereby authorized and directed to record said easement in the Public Records of Broward County, Florida. SECTION 3: This Resolution shall become effective upon adoption. PASSED, ADOPTED AND APPROVED this day of , 1982. ASSISTANT CITY CLERK I HEREBY CERTIFY that I have approved the form correctness of this Resolutio MAYOR: DISTRICT DISTRICT DISTRICT DISTRICT A s 4 NKYOR RECORD OF COUNCIL VOTE EASEMENT This Easement is made this AW day of June, 1982, by F&R BUILDERS, INC., a Florida corporation (the "Grantor") to the City of Tamarac, a municipal corporation (the "Grantee") W I T N E S S E T H: WHEREAS, Grantor is the fee simple owner of the real property described on Exhibit A attached hereto (the "Property") and WHEREAS, Grantor desires to create a non-exclusive easement in favor of Grantee for ingress and egress over the Property to construct, maintain, repair and replace a sewer line and all necessary laterals thereto, upon the terms and conditions set forth herein. NOW, THEREFORE, in consideration of the sum of One Dollar ($1.00) paid to Grantor the receipt and adequacy of which is hereby acknowledged, and for other good and valuable considerations, Grantor does hereby create, establish and grant, a non-exclusive easement on, over, under and through the Property to Grantee for the purpose of ingress and egress to construct, install, maintain, repair and replace a sewer line and all necessary laterals thereto. This non-exclusive easement is conditioned upon the Grantee's obligation to repair, restore or replace, (as the case -may be) the paved and/or sod area located in portions of the Property (and the real property adjacent thereto) which paved and/or sod area (and real property adjacent to the Property) may be damaged as a result or by reason of Grantee's wrongful or negligent acts or omission of Grantee or of its agents or employees in the course of their employment; and further, upon the obligation of Grantee to indemnify Grantor and its successors and assigns against any loss or damage occasioned thereby.
