R-82-Zfe) 3 A RESOLUTION ISSUING A DEVELOPMENT ORDER FOR THE WOODMONT 4 TRACT 74 AND 75 (BONAIRE) PROJECT. REVISED DEVELOPMENT ORDER NO. 021 AND PROVIDING AN EFFECTIVE DATE. 5 WHEREAS, pursuant to the instructions of the City Council of the City of Tamarac, Florida, a public meeting has been advertised in accordance with applica- ble law of the date, time and place of the meeting regarding the review of the 8 application for a revised development order by the applicant for development 9 approval; and, 10 WHEREAS, the City Council has examined and investigated the application, staff 11 and Planning Commission recommendations and the attached revised Develor-ment 12 Review Status Sheet dated July 9, 1982; and 13 WHEREAS, the City Council reviewed the revised development order and accompany- 14 ing documents at a public meeting; and 15 .WHEREAS, the City Council has determined that the application is in compliance 16 with all elements of its Comprehensive Plan, or will be in compliance prior to the 17 issuance of a Certificate of Occupancy for any unit on the development that is the 18 subject of the application. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: .0 SECTION I: That the application for approval of a revised site plan for 21 Woodmont Tract 74 and 75 (Bonaire) prepared by Keith and Schnars, P.A., revised 22 March 10, 1982, to show a reduction of units in Building No. 2 is approved 23 subject to the following conditions: 24 A. Construction is to be in complete compliance with the plans and 25 specifications submitted by the developer to the City of Tamarac as described in 26 Section II of the Development Review Status Sheet and approved engineering drawing: 27 B. Commencement of construction shall be no longer than one year from 28 the date of this approval. If the development does not commence construction 29 within one year, this approval is null and void unless an extension has been 30 , granted in accordance with applicable regulations. C. Additional conditiooes established in order to issue the order are set forth as follows: SECTION 2: Should any section or provision of this development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. SECTION 3: This development order as conditioned shall become effectiv( immediately upon its passage. PASSED, ADOPTED ACID APPROVED this zday of 1932.
