R-82- ,Z4ff 3 A RESOLUTION ISSUING A DEVELOPMENT ORDER 4 FOR THE HOPKINS PLAT PROJECT. DEVELOPMENT ORDER NO. 038 AND PROVIDING AN EFFECTIVE 5 DATE. WHEREAS, pursuant to the instructions of the City Council of the City of Tamarac, Florida, a public meeting has been advertised in accordance with applicablE 8 law of the date, time and place of the meeting regarding the review of the applica- 9 tion for a development order by the applicant for development approval; and 10 WHEREAS, the City Council has examined and investigated the application, 11 staff and Planning Commission recommendations, and the attached Development Review 12 Status Sheet dated July 5, 1982; and 13 WHEREAS, the City Council reviewed the develoip ent order and accompanying 14 documents at a public meeting; and 15 IN11EREAS, the City Council has determined that the application is in compliance 16 with all elements of its Comprehensive Plan, or will be in compliance prior to the 17 issuance of a Certificate of Occupancy for any unit on the development that is the 18 subject of the application. NOW, THE'ZEFORE, BE IT RESOLVED BY ',--HE COUNCIL OF THE CITY OF TA11ARAC, .:U FLORIDA: 21 SECTION 1: That the development described on the attached development review 22 status sheet dated July 5, 1982 is granted a development order to proceed subject 23 to the following conditions: 24 A. Construction is to be in complete compliance with the plans and sr_aecifica- 25 tions sumitted by the developer to the City of Tamarac as described in Section II 26 of the Development Review Status Sheet and approved engineering drawings. 27 ' B. Commencement of construction shall be no longer than one year from the 28 date of this approval. If the development does not commence construction within 29 one year, this approval is null and void unless are extension has been granted in 30 , accordance with applicable regulations. C. The development order is assignable, but an assignment does not discharge �i. any assignee from strict compliance with the order unless the City Council consents 33 to modify any of the original requirements. 34 35 36 Temp. Additional conditions established in order to issue the development order are set forth as follows: A) 0 /� Z�-- SECTION 2: Should any section or provision of this development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void.
