A RESSOIUTION ISSUING A DEVELOPMERT ORDER FOR THE
5 WESTVIEW AT COLONY WEST/PARCEL "R"

MMEFA.S, pursuant to the instructions of the City Council of the City of
8 Tamarac, Florida, a public meeting has been advertised in accordance with applicable
9 law of the. date, time and place of the meeting regarding the review of the applica-
10 tion-for a development order by the applicant for development approval; and
11 W[IvREAS, the City Council has examined and investigated the application,
staff and Planning Commission recamnendations, and the attached Development Review
13 Status Sheet dated 1 / 2 2 / 8 2 ; and
14 MiEFEAS, the City Council reviewed the development order and accmUzenying
15 documents at a public meeting; and
16 LAMAS, the City Council has deterraned that the application is in carr
17 pliance with all elements of its CcnTwehensive Plan, or will be in canpliance prior
18 to the issuance of a Certificate of Occupancy for any unit on the development that
is the subject of the application.
NOW, THEFJ70M, BE IT RESOLVED BY TJJE COUNCIL OF THE CITY OF TAMARAC,
21 FLORIDA:
22 SECTION 1: That the development described on the attached development review
23 status sheet dated 1/2 2 / 8 2 is granted a develcgnent order to proceed subject to
24 the following conditions:
25 A. Construction is to be in complete compliance with the plans and spec-
26 ifications sutmi.tted by the developer to the City of Tamarac as described in
27 Section II of the Develapnent Review Status Sheet and approved engineering drawings.
28 B. Camienc a ment of construction shall be no longer than one year from the
29 date of this approval. If the development does not commence construction within
30 one year, this approval is null and void unless an extension has been granted in

accordance with applicable regulations.
C. The development order is assignable, but an assignment does not
discharge any assignee .fran strict compliance with the order unless the City Council
consents to modify any of the original requirements.
D. Additional conditions established in order to issue the development
order are set forth following:

SITE PLAN
1. Payment of $50,400.00 for recreation fees.
2. Property to be rezoned to R4-10.
3. Seawall requirement around private lake is waived.
4. The following easements are approved:
a) Water and Sewer - 1/6/82.
b) Flow Through./On-Site - 1/6/82.
c) Ingress/Egress from clubhouse - 1/6/82
5. Dedication of additional right-of-way (1/6/82) is accepted.
6. Grant of non-exclusive drainage easement (1/20/82) is accepted.
7. Landscape islands may be moved up to 20-feet either way to save
the existing trees.
8. Relocate dumpsters to front of building.
9. Installation of guardrail at the McNab Road entrance parallel with the
lake and the guardrail at the southwest side of the pool deck.
10. Curb all sides of the median on McNab Road and backfill and sod with
Bahia grass and landscaping which is to be approved by the City Planner.
SECTION 2: Should any section or provision of this development order be
declared by a court of competent jurisdiction to be invalid, the City Council shall
determine if the other portions of the order remain valid or whether the approval
shall be null and void.
SECTION 3: This development order as conditioned shall become effective upon
adoption of the rezoning ordinance for Parcel "R".
PASSED, APPROVED AND ADOPTED this 27th day of January, 1982.
