R-82-Z/ O Temp. # 2303 Rev. 6/10/82 6/11/82 A RESOLUTION ISSUING A DEVELOPMENT ORDER FOR ASHMONT (KINGS POINT) REVISED SITE PLAN. REVISED DEVELOPMENT ORDER NO. 002; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Council of the City of Tamarac, Florida, a public meeting has been advertised in accordance with applicable law of the date, time and place of the meeting reg4rding the review of the application for a revised development order by the applicant for development approval; and WHEREAS, the City Council has examined and investigated the application, staff and Planning Commission recommendations; and WHEREAS, the City Council has determined that the application is in compliance with all elements of its Comprehensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for any unit on the devlopment that is the subject of the application. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the application for approval of a revised site plan for Ashmont (Kings Point), prepared by F & R Builders, Inc., revised May 10, 1982, amending the vehicular circulation and reducing the parking, pursuant to Stipulation 12, is approved subject to the following conditions: A. Construction is to be in complete compliance with the plans and specifications submitted by the developer to the City of Tamarac as described in Section II of the Development Review Status Sheet and approved engineering drawings. B. Commencement of construction shall be no longer than one year from the date of this approval. The development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unleE the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue the development order are set forth as follows: 1. Two (2) grass parking areas adjacent to 74th Place are elimi- nated, one of which will be relocated between Bldgs. B and D, and the second one will be located approximately between Bldgs. E and G, changes to be shown on the Mylar. 2. That,the hydrant presently located in the approximate area will be moved westward in compliance with the City Engineer. 3. Exhibits prepared by Dan Carnahan, dated June 4, 1982 concern: the chain link fence, four feet high, to be erected on the water side of the sidewalk at the canal on 100th Avenue and the north end of thi: property and at the canal on the west side of 71st place shall become part of the site plan and changes shown on the Mylar. SECTION 2: Should any section or provision of this development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. SECTION 3: This development order as conditioned shall become effective immediately upon passage.
