CITY OF TAMARAC
3 RESOLUTION NO. k
4 A RESOLUTION AUTHORIZING PARTICIPATION IN LITIGATION
.- CHALLENGING THE BROWARD COUNTY PLAT AND DEVELOPMENT
REVIEW ORDINANCE NO. 81-16; AND PROVIDING AN EFFECTIVE
DATE.
7 WHEREAS, the Broward County Commission has enacted a Plat and
8 Devel-opment Review Ordinance numbered Ordinance 81-16; and
9 WHEREAS, said Ordinance purports to permit Broward County to
10 "Independently Review" findings made by cities of sufficiency of essential
11 services; and
12 WHEREAS, said Ordinance raises basic questions of Municipal Home
13
Rule; and

WHEREAS, the municipalities within Broward County tried

unsuccessfully to find a middle ground approach to be taken in the County
15
Ordinance; and
WHEREAS, the only proper forum left to resolve those issues is the
Courts; and
WHEREAS, every reasonable alternative to litigation has been

explored; and

WHEREAS, the Broward County League of Cities has voted to co-
22
ordinate litigation on behalf of the municipalities.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
24
CITY OF TAMARAC

SECTION 1: The City of Tamarac finds that the proposed litigation
25
serves a public purpose and it agrees to participate as a party plaintiff.

in litigation co-ordinated by the Broward County League of Cities to
28
challenge Broward'County Ordinance No. 8116.
29
SECTION 2: The City of Tamarac agrees that the law firm of
Milledge and Hermelee is authorized to represent it in the action.
SECTION 3: The City of Tamarac agrees to participate financially
32
in the action. The initial contribution of $1,000.00 is hereby authorized
33
to be paid to the Broward County League of Cities for disbursement to
34
counsel.

SECTION 4: This Resolution shall be effective upon adoption.
