RESOLUTION NO. k — V— aZZ
A RESOLUTION ISSUING A DEVELOPMENT ORDER FOR THE ASHMONT
PROJECT. DEVELOPMENT ORDER NO. 1/81; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, pursuant to the instructions of the City Council of the City
of Tamarac, Florida, a public meeting has been advertised in accordance with
applicable law of the date, time and place of the meeting regarding the review
of the application for a development order by the applicant for development
approval; and
WHEREAS, the City Council has examined and investigated the
application, staff and Planning Commission recommendations, and the attached
Development Review Status Sheet dated 10/21/81; and
WHEREAS, the City Council reviewed the development order and
accompanying documents at a public meeting; and
WHEREAS, the City Council has determined that the application is in
compliance with all elements of its Comprehensive Plan, or will be in
compliance prior to the issuance of a Certificate of Occupancy for any unit on
the development that is the subject of the application.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: That the development described on the attached
development review status sheet dated 10/21/81 is granted a development order
to proceed subject to the following conditions:
A. Construction is to be in complete compliance with the plans and
specifications submitted by the developer to the City of Tamarac as described
in Section II of the Development Review Status Sheet and approved engineering
drawings.
B. Commencement of construction shall be no longer than one year
from the date of this approval. If the development does not commence
construction within one year, this approval is null and void unless an
extension has been granted in accordance with applicable regulations.
C. The development order is assignable, but an assignment does not

discharge any assignee from strict compliance with the order unless
the City Council consents to modify any of the original requirements
D. Additional conditions established in order to issue the
development order are set forth below:

Applicant has voluntarily agreed to place battery -operated smoke
detectors in each unit.
Payment of $28,405.00 recreation fees.
Improvements to be in conformance with engineering drawings date
October 8, 1981 approved by the City Engineer on October 21, 1981.
That the excavation of all canals not be closer than 30 feet from
the property line; the property line and water line being one.
That the additional excavatiops, for which they will be given
credit toward the 5% retention, will be excavated in a manner
that will be in compliance with the City's code and that no
excavation can be made any closer than 30 feet from the property
line.
5. Any guardrails that may need to be relocated by the city will be
subject to the City Engineer's approval, and any notes on the
engineering plans which relate to the guardrails will be dis-
regarded.
6. All other notes on the engineering plans as have been redlined
as of now will"be a part of this motion.
7. Extend the sidewalk to the center line of the canal at the south-
west corner and the northeast corner of this project.
8. Substitute the gumbo limbos for the shefflera along the rear of
the buildings as redlined on the site plan.
9. Provide second dumpsters for all two-story buildings as redlined
on the site plan.
10. Subjed.t to the appropriate fees being paid and bonds being postec
at the appropriate time.
SECTION 2: Should any section or provision of this development
order be declared by a court of competent jurisdiction to be invalid,
the City Council shall determine if the other portions of the order
remain valid or whether the approval shall be null and void.
