CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R- 81-216
A RESOLUTION APPROVING A PARTIAL VACATION OF
UTILITY EASEMENT ON LOT 11, BLOCK 25, THE
WOODLANDS SECTION 5.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
8 SECTION 1: That the partial vacation of utility easement
9 on Lot 11, Block 25, The Woodlands Section 5, for Jack and Priscilla
10 Rose, copy of which description is attached hereto as Exhibit "A" is
11 hereby approved.
12 SECTION 2: The City of Tamarac is cognizant of the
13 requirements of Section 177.101 F.S., and Chapter 28946 Laws of
14 Florida, Special Acts of 1953, as amended from time to.time, which
15 sets forth a procedure for partial vacation dedications granted in
16 plats and this vacation is contingent upon approval by the Broward
17 County Board of County Commissioners and satisfaction of all
requirements of Section 177.101 F.S. and Chapter 28946 Laws of
Florida, Special Acts of 1953, as amended from time to time, within
20 one year of the date of this approval.
21 SECTION 3: This Resolution is further subject to the
22 letter from American Cable TV of September 1, 1981, a copy of which
23 is attached hereto as Exhibit "B".
24 SECTION 4: This Resolution shall become effective upon
25 its adoption.
PASSED, ADOPTED AND APPROVED this 23rd day of September , 1981 .

Dear Mr. Beyer:
American Cable TV has no objection to the release of a four
(4) foot portion of the utility easement on the. East border of
the West ten (10) foot easement on the above -mentioned property.
However, we must stipulate that, in the event we are required to
excavate in the remaining portion of the easement for the purpose
of repair or replacement of our cable, we can bear no responsibility
for structural damage to the encroaching structure should such
occur.
