CITY OF TAMARAC, FLORIDA
RESOLUTION NO. /9 g/-/93
1 A RESOLUTION GRANTING AN EXCEPTION PERMIT FROM PLATTING REQUIRE-
MENTS FOR CERTAIN PROPERTY OWNED BY IRVING WALTMAN, AS TRUSTEE

BE IT.RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA:

SECTION 1: Findings of Fact
S 1. The property described on Exhibit A attached hereto is owned by

6 Irving Waltman, as Trustee.
7 2. The property is undeveloped and except for an entrance way to be
8 constructed to assist access to the adjoining property, this property is contem-
9 plated to remain undeveloped for the forseeable future.
10 3. The property described on Exhibit A is located on McNab Road.
11 4. The property described on Exhibit A is adjacent to the United
12 Federal Savings and Loan Association, which Association is located at the
13 Northwest corner of McNab Road and University Drive.
14 5. Broward County has done substantial road improvement work on
15 McNab Road. As part of said work, a median cut on McNab Road, which would
16 allow motor vehicles traveling in an easterly direction to enter the premises
occupied by United Federal, has been closed because said cut was too close to
18 the intersection of McNab Road and University Drive.
19 6. United Federal has arranged with the owners of the property
20 described on Exhibit A for there to be a driveway extending parallel to McNab
21 Road to allow vehicles to cross McNab Road at a median cut to be constructed
22 which is west of the median cut formerly used by United Federal.
23 7. Tamarac regulations require a site plan and plat of the undeveloped
24 property as a prerequisite to the construction of the driveway. Broward County
25 regulations would not require platting of the property described in Exhibit A
26 at this time.
27 8. An application has been made for an exception permit from the

platting requirements of the City pursuant to the terms of Section 20-4 of the
i9 City code which permits said permits for such land of size and shape that is in
strict conformity with the platting requirements would constitute a hardship.
31 9• The City Council finds that an undue hardship to United Federal
32 would exist because of the time frames required for platting and that since
33 there is no intention to use the property on Exhibit A for anything other than
34 a driveway at the present time, that platting would serve no useful purpose.
35 10. The City Council finds that granting of the exception for a
36 limited period of time would not set a precedent in any way for other and unlike

additions.
11. The City Council finds that such permit for exception to platting
requirements would not be detrimental to the interests of the community.
12. The City Council finds that no additional road right-of-way dedi-
cations are required on McNab Road at the present time and that if and when the
property described on Exhibit A is developed, than the question of road dedications
would be revisited.
13. The City Council finds that the property described in Exhibit A
has no need for water and sewer facilities unless and until it is further developed,
and at the time of future development, this question shall be revisited.
14. The City Council finds that no additional easements are required
in the property described on Exhibit A at this time and that no dedications or
recreational land is required for the proposed use of the property.
SECTION 2. An Exception Permit from the platting requirements of
Chapter 20 of the Tamarac City Code is hereby granted subject to the construction
of a driveway to serve United Federal Savings and Loan Association on a`temporary
basis and subject further to the condition that this Exception Permit is for a
limited duration and shall become null and void upon the approval of an application
for the development in any manner of any of the property described on Exhibit A.
SECTION 3. This resolution shall be effective upon adoption.
