A RESOLUTION APPROVING A CANAL MAINTENANCE EASEMENT
FOR TRACT 13A, LAND SECTION 6, TOWNSHIP 49 SOUTH,
RANGE 41 EAST, BROWARD COUNTY, FLORIDA OFFERED BY
F. & R. BUILDERS, INC., PURSUANT TO STIPULATION 10
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the EASEMENT FOR Construction, cleaning
and maintenance of the canal on Tract 13A, Land Section 6, Township
49 South, Range 41 East offered by F. & R. Builders, Inc., pursuant
to Stipulation No. 10 is hereby approved, copy attached Exhibit "A".
SECTION 2: This Resolution shall become effective immediate
ly upon its adoption.

EASEMENT FOR CANAL MAINTENANCE
THIS INDENTURE, made this 1st day of July, 1981, by and
between F & R BUILDERS, INC., a Florida corporation, (the "Grantor")
and the City of Tamarac, a municipal subdivision of the State of
Florida, and its successors in interest (the "Grantee").
W I T N E S S E T H
WHEREAS,'Grantor is the owner of the hereinafter described
land'in Broward County, Florida; and
WHEREAS, the parties hereto desire that the drainage canal
which will lie adjacent to said land be maintained and kept free
and clear of all obstructions, debris, filth , and other vegetable
matter, and the Grantor, to accomplish said purpose is willing to
convey to Grantee an easement herein described to be used by the
Grantee for the construction, cleaning and maintenance of said canal.
NOW, THEREFORE, in consideration of the premises, and the
sum of One Dollar ($1.00) in hand paid by the Grantee, the receipt
and adequacy of which is hereby acknowledged, the Grantor has
granted, bargained and sold, and by these presents does hereby
grant, bargain, sell and convey to the Grantee an easement over,
along and across the following described land lying and being
in Broward County, Florida:
See Composite Exhibit "A" attached hereto and made a
part hereof.
together with the right to remove all trees, growth and shrubbery
therefrom and to temporarily deposit such spoil, filth and other
vegetable matter which the Grantee shall remove from the canal from
time to time in the construction, cleaning and maintenance of said
canal, and together also with the right to the Grantee to use said
strip of land in such manner as may be necessary in the operation of
the equipment used by the Grantee in the construction and cleaning
of said canal.

All of the provisions herein shall inure to the benefit of
the assigns and the successors in interest of the parties hereto.
IN WITNESS WHEREOF, Grantor has set its hand and seal as of
the day and year first above written.
