RESOLUTION NO.
A RESOLUTION APPROVING AND ACCEPTING A TEMPORARY
CANAL ACCESS EASEMENT ON TRACT 13A LAND SECTION 6
TOWNSHIP 49 SOUTH, RANGE 41 EAST, BROWARD COUNTY,
FLORIDA FROM F. & R. BUILDERS, INC. FOR EXCAVATION
OF THE CANAL IN THIS TRACT.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the Temporary Canal Access Easement
Offered by F. & R. Builders, Inc. for canal excavation on Tract 13A
Land Section 6, Township 49 South, Range 41 East is hereby
approved, copy of which is attached as Exhibit "A".
SECTION 2: This Resolution shall become effective
immediately upon its adoption.

TEMPORARY ACCESS EASEMENT
THIS INDENTURE, made this 1st day of July, 1981, by and
between F & R BUILDERS, INC., a Florida corporation, (the "Grantor")
and the City of Tamarac, a municipal subdivision of the State of
Florida, and its successors in interest (the "Grantee").
W I T N E S S E T H:
WHEREAS, Grantor is the owner of the hereinafter described
land in Broward County, Florida; and
WHEREAS, the parties hereto desire that the Grantee be given
temporary access to excavate the canal which will lie adjacent to
said land, and the Grantor, to accomplish said purpose is willing
to convey to Grantee the easement herein described.
NOW, THEREFORE, in consideration of the premises, and the
sum of One Dollar ($1.00) in hand paid by the Grantee, the receipt
and adequacy of which is hereby acknowledged, the Grantor has
granted, bargained and sold, and by these presents does hereby
grant, bargain, sell and convey to the Grantee a temporary access
easement necessary to accomplish the excavation of the canal
referred to herein, over, along and across the following described
land lying and being in Broward County, Florida:
See Exhibit "A" attached hereto and made a part hereof.
This easement shall terminate upon the earlier of the completion
of the excavation of the canal or January 10, 1983.
All of the provisions herein shall inure to the benefit of
the assigns and the successors in interest of the parties hereto.
IN WITNESS WHEREOF, Grantor has set its hand and seal as of
the day and year first above written.
