A RESOLUTION APPROVING AND ACCEPTING A TEMPORARY
CANAL ACCESS EASEMENT ON TRACT 12 LAND SECTION 6
TOWNSHIP 49 SOUTH, RANGE 41 EAST, BROWARD COUNTY,
FLORIDA FROM F. & R. BUILDERS, INC. FOR EXCAVATION
OF THE CANAL IN THIS TRACT.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the Temporary Canal Access Easement
OFFERED by F. & R. Builders, Inc. for canal excavation on Tract 12
Land Section 6, Township 49 South, Range 41 East is hereby
approved, copy of which is attached as Exhibit "A".
SECTION 2: This Resolution shall become effective
immediately upon its adoption.

THIS INDENTURE, made this ;�Wday of July, 1981, by any
between F & R BUILDERS, INC., a Florida corporation, (the "Grantor")
and the City of Tamarac, a municipal subdivision of the State of
Florida, and its successors in interest (the "Grantee").
W I T N E S S E T H:
WHEREAS, Grantor is the owner of the hereinafter de�c:'i bed
land in broward County, Florida; and
i;:: , EAS, the parties hereto, dr�ire that the Grar.' c--�ven
temporary access to excavate the canal which will lie adjacL-nt to
said land, and the Grantor, to accomplish said purpose is willing
to convey to Grantee the easement herein described.
NCW, THEREFORE, in consideration of the premises, and the
sum of One Dollar ($1.00) in hand paid by the Grantee, the receipt
and adequacy of which is hereby ack:r.owleccec, the Grantor i,as
granted, bargained and sold, and by these presents does hereby
grant, bargain, sell and convey to the Grantee a temporary access
easement necessary to accomplish the excavation of the canal
referred to herein, over, along and across the following 6-scribed
land lying, and being in Froward County, Florida:
See Exhibit "A" attached hereto and made a part hereon.
This easement shall terminate upon the earlier of the completion
of the excavation of the canal or January 10, 1983.
All of the provisions herein shall inure to the benefit of
the assigns and the successors in interest of the parties hereto. _
IN WITNESS WHEREOF, Grantor has set its hand and seal as of
the day and year first above written.

A portion of Section 6, Township 49 South, Range 41 East, Broward County,
Florida, being more particularly described as follows:
Commencing at the Northwest corner of said Section 6; thence South 870 05'
27" East, along the North line of said Section 6, a distance of 925.31 feet;
thence South 15' 01' 02" East, a distance of 1624.70 feet to the Point of
Beginning of this description; thence continue South 15' 01' 02" East, a
distance of 71.34 feet to a Point of Curve, thence Southerly and Easturly
along the arc of a circular curve to the left, having a radius of 260.00 feet,
an arc distance of 377.87 feet to a Point of Tangency; thence North 81' 42'
41" East, a distance of 42.64 feet to a Point of Mrve; thence Easterly
along the arc of a circular curve to the right, having a radius of 400.00
feet, an arc distance of 222.51 feet; thence North 22' 22' 19" East, a
distance of 410.16 feet to an intersection with the arc of a circular curve
to the left, having a radius of 1160.00 feet, and whose radius point bears
South 10' 39' 37" West, from the last described point; thence Westerly along
the arc of said curve, an arc distance of 742.22 feet to the Point of Beginning.
