A RESOLUTION URGING THE BROWARD COUNTY COMMISSION TO COUNT ONLY TWENTY-FIVE PERCENT (25%) OF THE TRIPS GENERATED BY NON-RESIDENTIAL DEVELOPMENTS FOR THE PURPOSE OFCIRCULATINGIMPACT FEES; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Broward County Commission in effect implemented a policy in 1979 whereby commercial plats were charged road impact fees on twenty --five percent (25%) of the trips generated by the commercial development; and WHEREAS, this policy was based upon a recommendation by the County staff that recognized that a large portion of the trips generated by non-residential land users are a duplication of trips generated by residential uses and that requiring payment of impact fees based upon one hundred percent (100%) of non-residential trips results in double payment for the same trips; and WHEREAS, in 1980, the Broward County commission formally adopted a policy reducing the amount of trips counted for the purpose of calculating impact fees for commercial, office and industrial plats by seventy-five percent (75%); and WHEREAS, this formal policy was based upon the County staff's report that non-residential land uses should be charged only for non home -based trips and that industrial land uses should be treated in the same manner as commercial land uses; and WHEREAS, subsequently the Broward County Commission reversed its policy and required payment for one -hundred percent (100%) of trips generated by non-residential land uses; and WHEREAS, reports produced by the County Planning and Engineering Staffs, as well as studies presented by reputable traffic engineering firms, clearly indicate that there is no rational basis for such policy; and WHEREAS, continuing adherence to the current policy, in addition to being inequitable and requiring double payments for residential and non-residential trips, will discourage economic and industrial development which is directly contrary to the policies of the Broward County Land Use Plan; and T i 1 2 3 4 5 8 9 10 11 12 13 14 15 16 17 21 22 23 24 25 26 27 28 29 s: 3: 34 3! 31 WHEREAS, such impediments to economic development will cause irreparable harm to the tax base of Broward County and its twenty-nine (29) municipalities. NOW, THEREFORE, BE. IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1 That the Broward County Commission is hereby urged to follow the recommendations of its professional staff and other qualified traffic engineers by recognizing that the current Commission policy results in double payment for the same trips. SECTION 2: That the current policy is not in the best interest of the people of Broward County because it discourages and 'inhibits economic growth and development, reduces the governmental tax base and reduces the number of jobs available for the citizens of Broward County. SECTION 3: That the Broward County Commission is hereby urged to re --instate its former policy and count only twenty-five percent (25%) of the trips generated by non-residential developments for the purpose of calculating impact fees. SECTION 4: That this Resolution shall become effective immediately upon adoption.
