CITY OF TAMARAC, FLORIDA
RESOLUTION NO.
A RESOLUTION REQUESTING AN AMENDMENT TO THE FLORIDA TRUTH IN
MILLAGE ACT TO PERMIT THE ENACTMENT OF A BUDGET BY A LOCAL
GOVERNMENTAL AGENCY PRIOR TO THE ESTABLISHMENT OF A FINAL
MILLAGE RATE AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, in 1980 the Florida Legislature enacted a bill entitled the
Florida Truth in Millage Act, and
WHEREAS, said Act became law in 1980, and
WHEREAS, one aspect of the Act is to require local governmental bodies
to enact a millage rate prior to the enactment of a budget, and
WHEREAS, it is patently illogical to enact a tax rate based in part
upon a budget that is not yet in existence, and
WHEREAS, the City Council of the City of Tamarac, Florida received
tremendous criticism from the public during the enactment of the 1980/1981 budget
and millage rates because it followed the law and enacted the millage rate before
it enacted the final budget, and
WHEREAS, it would appear that the public as well as the City Council
would prefer to have the budget enacted and considered first.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That the Florida Legislature is implored to modify
the Truth in Millage Act to permit or to require the enactment of a budget prior
to the enactment of a millage rate.
SECTION 2: That a copy of this Resolution shall be furnished to
each Legislator representing Broward County, to the Florida League of Cities
and to the Broward League of Cities.
SECTION 3: This Resolution shall become effective upon adoption.
