R- S%—/�� A RESOLUTION APPROVING AN AGREEMENT WITH RICHARD RUBIN FOR PLANNING CONSULTANT PURSUANT TO PRIVISIONS OF THE FLORIDA CONSULTANTS COMPETITIVE NEGOTIATIONS ACT. WHEREAS, the City Council deemed it in the best interest of the City to employ the services of a consulting planner; and WHEREAS, the City advertised for an expression of interest for such services in the newspaper of general circulation in the City, pursuant to the provisions of the Florida Consultants Competitive Negotiations Act; and WHEREAS, the City Council successfully negotiated with the applicant of their choice. NOW, THEREFORE, BE'.IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC FLORIDA: SECTION 1: That Richard Rubin, A.I.A. was selected,after competitiv, interviews,to be the Consulting Planner for the City of Tamarac under the terms and conditions of the Agreement, copy of which is attached as Exhibit "A". SECTION 2: That the appropriate City Officials are hereby authorized and instructed to execute this Agreement on behalf of the City. SECTION 3:•This Resolution shall become effective immediately upon its adoption. W I T N E S S E T H: FOR AND IN CONSIDERATION OF THE MUTUAL COVENANTS CONTAINED HEREIN, the parties agree as follows: 1. STATEMENT OF FACTS The CITY OF TAMARAC, pursuant to the provisions contained within the Florida Consultants Competitive Negotiations Act, advertised for a Planning Consultant. RICHARD RUBIN was selected by the City Council as the most qualified applicant and the purpose of this Agreement is to set forth the parameters of the engagement of RICHARD RUBIN as the Planning Consulting for the CITY OF TAMARAC. 2. DUTIES RICHARD RUBIN shall serve as Planning Consultant and shall perform the duties set forth in the job description, attached to this Agreement as Exhibit "A", and shall perform such additional duties as may be requested by the City Council, the City Manager or the City Attorney. 3. COMPENSATION RICHARD RUBIN shall be compensated for services performed on behalf of the City of Tamarac in the amount of TWO THOUSAND ONE HUNDRED ($2,100.00) DOLLARS per month for a minimum of eighty (80) hours. Hours worked in excess of eighty (80) hours per month shall be compensated at the rate of Thirty ($30.00) Dollars per hour. If in a given month RICHARD RUBIN works less than eighty (80) hours, his compensation for the following month shall be reduced by the amount of Thirty ($30.00) Dollars per hour for each hour less than eighty (80) hours worked during the preceding month. 10A� The compensation paid shall be net. There shall be no benefits provided by the CITY and no travel monies or expense monies other than blueprinting or photographic materials paid by the CITY for travel within Broward, Dade or Palm Beach Counties. 4. SUBCONTRACTS PROHIBITED The parties agree that all work performed pursuant to the terms of this contract shall be performed by RICHARD RUBIN and no work shall be subcontracted to other parties or firms by Mr. RUBIN without the express written consent of the City Council of the CITY OF TAMARAC. 5. OFFICE The parties agree that RICHARD RUBIN shall open a professional office to be located within Broward County west of the Florida Turnpike and that an office west of the Florida Turnpike within Broward County shall be maintained during the duration of this Agreement. 6. ASSIGNMENT The parties agree that this Agreement may not be assigned by either party provided, however, that RICHARD RUBIN may form a Professional Association or Partnership in which event he may assign the terms of this Agreement to that Association or Partnership. 7. COMMENCEMENT AND EXPIRATION This Agreement shall be effective upon July 13, 1981 and shall continue in effect until such time as either party gives the other party written notice of its intention to terminate this Agreement thirty (30) days hence. The financial terms of this Agreement (Paragraph 3) shall be subject to annual review. 8. CONFLICTS OF INTEREST The parties agree that RICHARD RUBIN shall not accept new clients involved in the development of property within the CITY OF TAMARAC or projects in Broward County controlled by Developers working in the City of Tamarac, however, he may continue to be involved in one project in Sunrise owned in part by the developers of Edgewater Village in Tamarac. ATTEST: ATTEST: 1 CITY OF TAMARAC By Th CITY M' 1 QK This.,�day of/ i RICHARD RUBIN i s_L> ay o - 198 CONSULTANT CITY PLANNER MAJOR RESPONSIBILITIES PLANNING AND MANAGEMENT COORDINATION OF ALL PRIVATE DEVELOPMENTS WITHIN TAMARAC INCLUDING: 1. Administrative review and on site inspection of all site and beautification plans to insure compliance with all applicable laws and legislative requirements. 2. Assist in preparation of all planning and zoning related ordinances, regulations and standards. 3. Attendance at all meetings related to the above items including Planning Commission, City Council, Beautification Committee and Board of Adjustment. 4. Preparation of schematic site and land use plans and land use studies or grant applications requested by City Council or City Manager for the purpose of feasibility studies, grant applications or general upgrading of Tamarac's physical environment.
