RESOLUTION NO. R-2019- GC
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, APPROVING A DEED OF
CONVEYANCE BY AND BETWEEN THE CITY OF
TAMARAC AND THE STATE OF FLORIDA DEPARTMENT
OF TRANSPORTATION (FDOT) TO CONVEY A PORTION
OF LAND WHICH LIES ADJACENT TO STATE ROAD 7
(U.S. 441) AND STATE ROAD 870 (COMMERCIAL
BOULEVARD); AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO EXECUTE SAID DEED OF CONVEYANCE
BY AND BETWEEN THE CITY OF TAMARAC AND THE
STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATION (FDOT) TO CONVEY A PORTION OF
LAND WHICH LIES ADJACENT TO STATE ROAD 7 (U.S.
441) AND STATE ROAD 870 (COMMERCIAL
111 BOULEVARD); AUTHORIZING THE CITY CLERK TO
FORWARD A CERTIFIED COPY OF THIS RESOLUTION TO
FDOT; PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City of Tamarac, Florida is the owner of property which lies
adjacent to State Road No. 7 (U.S. 441) and State Road No. 870 (Commercial
Boulevard), Item/Segment No. 4413231 , Section 86100-2510, in Broward County, Florida
and
WHEREAS, it is necessary that certain lands now owned by the City of Tamarac,
Florida, be conveyed to the State of Florida Department of Transportation: and
WHEREAS, said property is not needed for City purposes: and
WHEREAS, the State of Florida Department of Transportation has made
application to said City to execute and deliver to the State of Florida Department of
Transportation a deed, or deeds, in favor of the State of Florida Department of
Transportation, conveying all rights, title and interest that said City has in and to said

lands and said request having been duly considered, a copy of said Deed is attached
hereto attached as Exhibit A and is incorporated herein and made a specific part of this
Resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, THAT:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution
upon adoption hereof. All exhibits attached hereto are incorporated herein and made a
specific part of this Resolution.
SECTION 2: The application of the State of Florida Department of
Transportation for a deed, or deeds, is for transportation purposes which are in the public
or community interest and for public welfare and the land needed for transportation
purposes is not needed for City purposes; that a deed, or deeds, in favor of the State of
Florida Department of Transportation conveying all right, title and interest of the City of
Tamarac, in and to said lands should be drawn and executed by this Board of City
Commissioners. A copy of the Deed to convey said lands is attached hereto as Exhibit
"A". Consideration shall be $1.00.
SECTION 3: That a certified copy of this Resolution shall be forwarded to
the State of Florida Department of Transportation at 3400 W. Commercial Boulevard, Ft.
Lauderdale, Florida 33309.
SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 5: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid,
in part or application, it shall not affect the validity of the remaining portions or applications
of this Resolution.

SECTION 6: This Resolution shall become effective immediately upon its
passage and adoption.

Tamarac, Florida 33321, Grantor, to the STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATION, Grantee: (Wherever used herein the terms "Grantor" and "Grantee" include all the
parties to this instrument and the heirs, legal representatives and assigns of individuals,and the successors,
and assigns of organizations).
WITNESSETH: That the Grantor, for and in consideration of the sum of$1.00 and other valuable
considerations, receipt and sufficiency being hereby acknowledged, hereby grants, bargains, sells, aliens,
