ORDER APPROVING SPECIAL EXCEPTION
W The applicant, McHems Placide, designated agent for the property owner, YDB Three
Lakes, Flager Real Estate Services, LLC, filed an application with the City of Tamarac ("City")
Q" Department of Community Development for the following Special Exception Use:
Special Exception Approval to permit the operation of a hall for hire, commonly
known as a banquet hall, in the MU-C (Mixed Use Corridor) Zoning District
pursuant to the Table of Allowed Uses, Section 10-3.2, Tamarac Code of
Ordinances.

Notice of the request for the Special Exception Use was given as required by law. The
Planning Board finds that the property is located in the MU-C (Mixed Use Corridor) Zoning
District. Pursuant to Sections 2-369, 2-370, 10-3.2 and 10-5.4(G) of the City of Tamarac Code of
Ordinances, and following the consideration of all testimony and evidence presented at the
hearing on July 3, 2019, the Planning Board further finds:
(1) The proposed development will be consistent with the Comprehensive Plan.
(2) The proposed development will comply with applicable zoning district use and
development standards of the City's Code.
(3) The proposed development is compatible with the existing natural environment
and community character of the properties within the immediate neighborhood.
(4) The proposed use is deemed desirable for public convenience, and not injurious
or otherwise detrimental to the public health, safety, comfort and welfare.
(5) The design of the proposed use shall minimize adverse effects, including noise,
light, dust or other potential nuisances, of the proposed use on adjacent
property through the use of building orientation, setbacks, buffers, landscaping
and other design criteria consistent with the city regulations to the greatest
extent possible. Entire site shall be void of any pre-existing code violations.
(6) The proposed development will include adequate provisions for safe and
convenient vehicular and pedestrian traffic movement to, from, and through the
site that minimizes traffic congestion in the public streets;
(7) The site area is sufficient, appropriate, and adequate for the use and any
reasonably anticipated expansion of the use;
(8) The Special Exception shall only remain valid during the period of which the
certificate of occupancy and business license remains active.
(9) The Special Exception is transferable administratively pursuant to compliance
with City Codes, submitting documentation and payment of fees only after the
previous condition has been met; and
(10) Any pre-existing code violations shall be satisfied before a certificate of
occupancy is issued for the proposed use.
Pursuant to the authority contained in Section(s) 2-369, 2-370, 10-3.2 and 10-5.4(G) of the City
of Tamarac Code of Ordinances, the Applicant's application for a Special Exception for the use
of a hall for hire as requested, and as set forth above for the location at 3186-3190 W.
Commercial Boulevard, Tamarac, Florida, is hereby, APPROVED, subject to the following
conditions:
1. No alcohol shall be served on the premise without obtaining the appropriate license from
the State of Florida licensing authority.
2. Once an alcoholic beverage license is obtained, the facility shall not serve alcoholic
beverages Mondays to Thursdays after 1 I p.m. and Fridays to Sundays after 1 a.m.
3. The facility shall not actively operate, host any functions, or be open to the public after
11 p.m. Mondays to Thursdays and 1 a.m. Fridays to Sundays.
4. All activities related to this use shall be confined to the interior of the space
5. Security shall be provided for all events after 9 p.m.
