The applicant, Shantal Pierre & Edna Hurst the designated agent for the property owner,
RM TAMARAC PLAZA LP (the "Applicant"), filed an application with the City of Tamarac
("City") Department of Community Development for the following Special Exception Use:
Special Exception approval to allow for the operation of a private childcare facility
in the MU-C (Mixed Use Corridor) Zoning District pursuant to the Tamarac Code of
Ordinances.
Notice of the request for the Special Exception was given as required by law. The Planning
Board of the City of Tamarac ("Board") has identified that the property located at 7501 N W. 57t'
Street, Tamarac, Florida (the "Property") is in the MU-C, (Mixed -Use Corridor) Zoning District,
and following consideration of all testimony and evidence presented at the hearing on February 6,
2019 the Board finds as follows:

(a) The proposed development is consistent with the Comprehensive Plan;
(b) The proposed development does comply with applicable zoning district, use, and
development standards of this Code;
(c) The proposed development is compatible with the existing natural environment and
community character of the properties within the immediate neighborhood;
(d) The proposed development is desirable for public convenience, and not injurious or
otherwise detrimental to the public health, safety, comfort, and welfare;
(e) The proposed development does minimize adverse effects, including noise, light, dust, or
other potential nuisances, on adjacent properties to the greatest extent practicable;
(f) The proposed development does include adequate provisions for safe and convenient
vehicular and pedestrian traffic movement to, from, and through the site that minimizes traffic
congestion in the public streets;
(g) The site area is sufficient, appropriate, and adequate for the use and any reasonably
anticipated expansion of the use;
(h) The Special Exception shall only remain valid during the period of which the certificate
of occupancy and business license remains active;
(i) The Special Exception is transferable administratively pursuant to compliance with City
Codes, submitting documentation and payment of fees only after the previous condition has been
met; and
0) Any pre-existing code violations shall be satisfied before a certificate of occupancy is
issued for the proposed use.
Pursuant to the authority contained in Section 10-5.4 (G) of the City of Tamarac Land
Development Code, the Applicants' request for Special Exception approval as outlined is hereby
GRANTED. subject to the following conditions:
1. Approval of the special exception is contingent upon approval of the Site Plan
Approval, Minor application for Case #19-SP-18.
