R-2019- 7dp A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING A THREE (3) YEAR DEDICATED INTERNET ACCESS (DIA) SERVICES AGREEMENT WITH CROWN CASTLE FIBER LLC, PAID MONTHLY, FOR A TOTAL CONTRACT COST AND EXPENDITURE OF $70,560; AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE ASSOCIATED CONTRACT DOCUMENTS; AUTHORIZING BUDGET AMENDMENTS FOR PROPER ACCOUNTING PURPOSES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, technology is one of the key components in the efficient delivery of City services, and the City's Internet service is critical to ensuring continued operations; and WHEREAS, the City's Internet service is currently provided by Crown Castle Fiber LLC, and leverages an underground fiber network to provide high reliability and resiliency; and WHEREAS, more City services now rely on the Internet, and it is essential that the City maintain a robust Internet connection capable of supporting this increased traffic load; and WHEREAS, the City's current Dedicated Internet Access (DIA) services Temp Reso. 13291 August 28,2019 Page 2 agreement with Crown Castle Fiber LLC expires in July 2019, and as such the City has received renewal pricing from Crown Castle Fiber LLC, as shown in Exhibit 1, which will upgrade the City's Internet service from 300 Mbps to 1 Gbps (1,000 Mbps), and, will provide an increased number of static, public IP Addresses (to support the growing number of online services that the City provides); and WHEREAS, the proposed contract has a thirty-six (36) month term, with monthly payments of $1,960 per month, having a total contract cost of $70,560, and is based on General Services Administration (GSA) Schedule 70, Contract Number GS-35F-465DA, dated August 18, 2016, expiring August 17, 2021, available on file at the City Clerk's Office; and WHEREAS, the City is authorized to use GSA contracts without the requirement for formal competitive solicitation as permitted by Section 6-148(e) and Section 6-148(i) of the City of Tamarac Code, which allows the waiver of purchasing procedures; and WHEREAS, it is the recommendation of the Director of Information Technology and the Purchasing/Contracts Manager that the City renew its Dedicated Internet Access (DIA) services contract with Crown Castle LLC, for a three (3) year term at a total contract cost of$70,560; and WHEREAS, funding for Internet services is available in the Information Technology Internet services account; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to execute a three (3) year Dedicated Internet Access (DIA) Services Agreement with Crown Castle LLC. Temp Reso. 13291 August 28,2019 Page 3 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing 'WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. All exhibits attached hereto are incorporated here and made a specific part of this Resolution. SECTION 2: The City Commission hereby approves the three (3) year Dedicated Internet Access (DIA) Services Agreement with Crown Castle Fiber LLC, providing for monthly payments of $1,960 per month, for a total contract amount of $70,560, and further authorizes the appropriate City Officials to execute all necessary documents to effectuate this Agreement, including the Service Order Form, attached herein as Exhibit 2, and IP Address Request Form, attached herein as Exhibit 3, with Crown Castle Fiber LLC for said Dedicated Internet Access (DIA) services contract renewal. SECTION 3: Funding for Internet services is available from the appropriate accounts at a total contract amount of$70,560. SECTION 4: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
