CITY COMMISSION MEETING
WEDNESDAY, AUGUST 28, 2019
CALL TO ORDER: Mayor Gomez called the Commission Meeting of the City of Tamarac to
order at 9:05 a.m. on Wednesday, August 28, 2019, in City Commission Chambers, Tamarac
City Hall, 7525 NW 88th Avenue, Tamarac, FL 33321.
ROLL CALL: Mayor Michelle J. Gomez, Vice Mayor Debra Placko, Commissioner Marlon
Bolton, Commissioner Mike Gelin and Commissioner Julie Fishman were in attendance.
Also in attendance were City Manager Michael Cernech, City Attorney Samuel S. Goren and
City Clerk Patricia A. Teufel.
PLEDGE OF ALLEGIANCE: Commissioner Fishman led the Pledge of Allegiance.
Mayor Gomez called for a moment of silence in memory of Operations Manager John
Engwiller of Tamarac's Public Services Department who recently passed away.
1 . PROCLAMATIONS AND PRESENTATIONS:
a. Introduction to Mayor & Commission by Representative Dan Daley. Representation Daley
said he is pleased to come before the Commission and introduce himself. Rep. Daley said
he feels residents should be able to reach him if they need his assistance and provided his
phone number, 954-778-3304. Rep. Daley said he is looking forward to working with the
Commission and noted that he is a protector of Home Rule.
Mr. Angel Gomez introduced himself to the Commission. Mr. Gomez was the former
principal at Piper High School and is now a Liaison with Governmental Affairs for the School
Board of Broward County. Mr. Gomez said if the Commission has any questions about the
School Board to contact him
b. Presentation of a proclamation by Mayor Michelle J. Gomez commending Tamarac
Resident Robert Santiago for His Assistance at a Fire on June 4, 2019. (Requested by
Assistant Fire Marshal Tommy Demopoulos)
c. Presentation of a proclamation by Mayor Michelle J. Gomez proclaiming September 12,
2019 as "Broward Mental Health Summit Day". (Requested by Commissioner Julie Fishman)
d. Presentation by Mayor Michelle J. Gomez of Employee Service Awards:

2. CITY COMMISSION REPORTS:
a. Commissioner Bolton: Commissioner Bolton thanked everyone in attendance of the
meeting. Commissioner Bolton said that over the summer hiatus he was still working and

making phone calls and emails. Commissioner Bolton said that there was so many things that
happened over the summer he will be sending an email and makes posts to Facebook.
Commissioner Bolton said he attended the Back to School Drive in District 1 in Shaker
Village. Commissioner Bolton said Tamarac faces aging infrastructure, traffic and equitable
distribution of services on the east side. When he travels out of Tamarac and meets with
over 2,000 other leaders and delegates they share solutions for challenges and that is why
travel is important. Commissioner Bolton reported that he went to Mississippi to attend the
National Black Caucus of Local Elected Officials Conference and he went to Orlando to
attend the Florida League of Cities 2019 Annual Conference. Commissioner Bolton noted
that City Manager Cernech was leaving to take a position in Delray Beach and he hopes they
realize the gem they are getting in him. Commissioner Bolton said that he did not always see
eye to eye with City Manager Cernech but he respects his leadership, work ethics and
dedication to Tamarac. Commissioner Bolton said you can follow him on Facebook and reach

b. Commissioner Gelin: Commissioner Gelin gave a PowerPoint presentation on his activities
since the last meeting, a copy of which is on file in the City Clerk's Office. Commissioner
Gelin went over some of the emails he received relative to his decision about the 13th Floor
project in the Woodlands. Commissioner Gelin said he attended the Welcome Back to School
event held at his son's school and went over his summer activities. He attended the following
conferences: Sister Cities Conference; Center for Popular Democracy Conference and the
Florida League of Cities Conference. Commissioner Gelin talked about Hurricane Dorian.
Commissioner Gelin went over the various social media venues where you can follow him.
Commissioner Gelin talked about eliminating districts in Tamarac in order for people to be
able to vote on a city-wide basis
c. Commissioner Fishman: Commissioner Fishman said she has been busy during the
summer break. Commissioner Fishman said she attended the Florida League of Cities
Annual Conference where they learned they will be working on a bill to address vacation
rentals and she will bring back more information to the Commission as it develops; she will
also have information on this in her newsletter.
d. Vice Mayor Placko: Vice Mayor Placko said she was in Orlando at the International Council
of Shopping Centers Conference along with Assistant City Manager Gunn, Economic
Development Manager Lori Funderwhite and Administrative Coordinator Skenandore. While
there she ran into the owner of the new Pollo Tropical. This was an excellent Conference
and they made a lot of good contacts. Vice Mayor Placko says the summer hiatus allows the
Commission the time to reach out to their constituents on a 1 to 1 basis. Vice Mayor Placko
reported that she met the new principal at Tamarac Elementary and was in attendance on the
first day of school.
e. Mayor Gomez: Mayor Gomez said she attended the Tamarac Historical Society's 10th
Anniversary celebration. Mayor Gomez said she appreciates all the hard work the Public
Information Office, Parks & Recreation staff and Public Services staff did during the
watermain break. Mayor Gomez said she also appreciates the art work that Susan Buzzi did
relative to Human Trafficking. Mayor Gomez reported that she attended the grand openings
of three restaurants in Tamarac. Mayor Gomez said she is looking forward to the bus tour of
the City with local, state and federal elected officials to showcase the City. Mayor Gomez said
she attended the commissioning of the USS Paul Ignatius, the ground breaking for the
Community Christian Church expansion, a meeting with Sheriff Tony and various Backpack

Give Aways. Mayor Gomez thanked the Red Cross and Tamarac Fire Rescue for the
installation of smoke detectors in some of our resident's homes. Mayor Gomez said the
Commission is always available for the residents and businesses of Tamarac.
3. CITY ATTORNEY REPORT: City Attorney Goren said during the hiatus they sent analyses
on several bills and he will be happy to discuss those with the Commission. City Attorney
Goren highlighted the following bills among others: HB7103 — Community Development and
Affordable Housing; SB82 — Vegetable Gardens; SB426 — Benefits for Firefighters with
Cancer; HB861 — Financial Reporting; HB1159 — Tree Ordinance; HB127 — Posting of Permit
Fees and Utilization Reports and HB 829 —Attorney's Fees for Damages in Civil Actions.
4. CITY MANAGER REPORT: City Manager Cernech welcomed everyone back and thanked
everyone for their kinds words about Delray Beach and said he will keep the Commission
informed as it moves forward. City Manager Cernech announced that the International
City/County Association has advised that Tamarac has been recognized for its Data-driven
Management and Reporting Efforts with a Certificate of Excellence in Performance
Management. This is the Fifth consecutive time we have received this prestigious recognition.
City Manager Cernech noted that Human Resources received Cigna's "Outstanding Culture
of Well-being Award". This award is a testament to the hard work and dedication put forth by
HR, The Wellness Champion Committee, the Executive Team and every employee who
supports the City's efforts.
Upcoming Events: "Free Fitness Fridays" will begin in September. City Manager Cernech
invited people to attend a free outdoor adult group fitness class at the Caporella Aquatic
Center on the 2nd Friday of the month from September thru December 2019 from 6-7 p.m.
Classes include Power Sculpt, Sizzle and Scuplt, Xumba and Tai Chi. Classes are subject to
cancellation due to inclement weather and schedule are subject to change.
City Manager Cernech said Public Services has advised that the Boulevard Sidewalk
Extension Project is now complete.
5. PUBLIC PARTICIPATION: Mayor Gomez opened Public Participation and the following
individuals spoke: Jeffrey Shapiro, 6104 Orchard Tree Lane, talked about WHOA entering
into an agreement with 13th Floor; Jill Lewis 3851 W. Prospect Rd., asked the Commission to
look into the Residents of Tuscan Villas Condos being able to receive water from Tamarac
and not the City of Ft. Lauderdale as it is too expensive; Ron Wasserman 8577 Jade Dr.,
spoke about various items and Joel Davidson, 4608 Norfolk Pine Island Dr. spoke about the
Woodlands HOA meeting and agreement with 13th Floor.
6. CONSENT AGENDA: Mayor Gomez asked City Manager Cernech if there were any
changes/additions to the Consent Agenda and City Manager Cernech said there is a
correction to the July 10, 2019 minutes at the request of Mayor Gomez to reflect that Mayor
Gomez said she did not receive any campaign contributions from 13th Floor or Scott
Backman's office for her 2018 campaign account. Item No. 6 (j) has been amended to reflect
Commissioner Gelin's appointment of Natasha Exemar to the Park & Recreation Board. Item
No. 6 (k) has been amended to reflect the appointments of Eric Gnage and George Odom as
Alternates to the Planning Board. Commissioner Fishman seconded by Vice Mayor Placko
moved to add TR13323 and TR13324 to the Consent Agenda as amended. Commissioner
Bolton asked for clarification on the correction to 6 (a) and Mayor Gomez confirmed that she
did not receive any contributions from 13th Floor or Scott Backman for her 2018 campaign

account and that the original minutes omitted the word "not" and the minutes are being
revised to include the word "not". Commissioner Gelin asked Mayor Gomez about accepting
contributions from a Political Action Committee and Mayor Gomez said she did not receive
any money directly. City Attorney Goren stated that Mayor Gomez's statement is on the
record. Commissioner Bolton made a substitute motion to add 6 (j) TR13323 and 6 (k)
TR13323 to the Consent agenda and add 6(a) separately. Motion passed (3-2) with
Commissioner Fishman and Mayor Gomez dissenting. City Attorney Goren said 6 (j)
TR13323 and 6 (k) TR13323 have been added to the Consent agenda as amended.
Commissioner Fishman seconded by Vice Mayor Placko moved to add item 6 (a) to the
Consent Agenda as amended. Motion passed (3-2) with Commissioner Bolton and
Commissioner Gelin dissenting. Commissioner Bolton pulled items 6 (d) TR13313 and 6 (i)
TR13327 for discussion. Commissioner Gelin seconded by Commissioner Bolton moved
approval of the Consent Agenda as amended with the exception of 6 (d) TR13313 and 6 (i)
TR13327. Motion passed unanimously (5-0).
a. Approval of the July 10, 2019 Regular Commission Meeting Minutes — APPROVED AS
AMENDED
b. Approval of the June 26, 2019 Regular Commission Meeting Minutes - APPROVED
c. TR13315 - MOU In support of Solid Waste Independent District: A Resolution of the City of
Tamarac, Florida, approving a Memorandum of Understanding ("MOU") regarding
Collaborative Study and Subsequent Development of an Integrated Solid Waste and
Recycling System; authorizing the appropriate City Officials to execute said MOU and to take
the appropriate steps to effectuate the MOU; providing for conflicts; providing for severability;
and providing for an effective date.

e. TR13291 - Crown Castle Fiber Internet Service Renewal: A Resolution of the City
Commission of the City of Tamarac, Florida, authorizing appropriate City Officials to execute
a three (3) year Dedicated Internet Access (DIA) services agreement with Crown Castle Fiber
LLC, paid monthly, for a total contract cost and expenditure of $70,560; authorizing execution
of associated contract documents, authorizing budget amendments for proper accounting
purposes; providing for conflicts; providing for severability; and providing for an effective date.

f. TR13322 - Approval of Liability Waiver Agreement with BSO's Fire Rescue Regional
Logistics Unit A Resolution of the City Commission of the City of Tamarac, Florida, to
approve a Liability Waiver Agreement renewal with the Broward Sheriffs Office (BSO) to
purchase emergency medical and firefighting equipment and supplies from Broward County
Sheriff's Office Fire Rescue Regional Logistics Unit in an amount of one hundred and
seventy-four thousand ($174,000) dollars for FY20 and one hundred and eighty-six thousand
($186,000) dollars for FY21 for a total amount not to exceed three hundred and sixty
thousand ($360,000) dollars for the two-year period and authorize the City Manager to extend
the total dollar amount by an additional twenty five thousand ($25,000) dollars annually based
upon exigent circumstances; authorizing the appropriate City Officials to execute a Liability
Waiver Agreement for the purchases; providing for conflicts; providing for severability; and
providing for an effective date.

g. TR13304 - Broward College Agreement for EMS Internship Program: A Resolution of the
City Commission of the City of Tamarac, Florida, approving a five (5) year-term Agreement
for Emergency Medical Services (EMS) Internship Program between the City of Tamarac and
Broward College to allow EMS students to ride along on City's fire rescue vehicles as part of
a preceptorship program and receive education and training from Tamarac Fire Rescue
personnel with an effective date upon execution by all parties, authorizing appropriate City
Officials to execute an agreement for EMS Internship Program; providing for conflicts;
providing for severability; and providing for an effective date.

h. TR13321 - Amendment 2 to Medical Billing Services: A Resolution of the City Commission
of the City of Tamarac, Florida approving Amendment 2 to the Agreement with Advanced
Data Processing Inc. (ADPI) a subsidiary of R1 RCM Inc. and authorizing the appropriate City
Officials to execute Amendment 2 to provide for the administration, processing and collection
of all costs associated with transport of emergency medical services (EMS) patients medical
billing and related professional services on behalf of the City of Tamarac Fire Rescue
Department with an effective date upon execution of the amendment through September 30,
2021; providing for conflicts; providing for severability; and providing for an effective date.

j. TR13323 - Appointments to Parks & Recreation Board: A Resolution of the City
Commission of the City of Tamarac, Florida, appointing one members to the Parks and
Recreation Board to serve terms concurrent with the appointing Commission Member, or until
such time as new appointments are made; providing for conflicts; providing for severability;
and providing an effective date.

k. TR13324 - Appointments to Planning Board: A Resolution of the City Commission of the
City of Tamarac, Florida, appointing two (2) Regular Members to the Planning Board; to
serve terms concurrent with the appointing Commission member, or until such time as new
appointments are made; providing for conflicts; providing for severability; and providing an
effective date.

I. TR13325 - Appointment to Public Art Committee: A Resolution of the City Commission of
the City of Tamarac, Florida, appointing one (1) member to the Public Art Committee; to
serve a term concurrent with the appointing Commission Member, or until such time as new
appointments are made; providing for conflicts; providing for severability; and
providing an effective date.

Commissioner Fishman seconded by Vice Mayor Placko moved approval of getting item 6 (d)
TR13327 on the table for discussion. City Attorney Goren read TR13313 by title into the
record. Commissioner Bolton said on Monday he requested information from the Chamber of
Commerce which he received yesterday. Tamarac and No. Lauderdale fund the Chamber of
Commerce and money should be used equally to fund all their projects. Commissioner Bolton
said the Taste of Tamarac should be supported more by No. Lauderdale. Commissioner
Bolton went over the list of in-kind support that the City of Tamarac provides for this event
and said this is a joint effort and No. Lauderdale should be sharing the responsibility.

Tamarac's staff does all the work and No. Lauderdale does not and there should be equitable
distribution of all activities. Commissioner Bolton said Community Development Director
Calloway provided him with a list of all the restaurants in Tamarac and he called them and
asked if they knew about the Taste of Tamarac and they all said no. Commissioner Bolton
said if we are going to be inclusive we should engage everyone.
Commissioner Bolton said his second issue is that we now have an Economic Development
Director Lori Funderwhite and Assistant City Manager Gunn and questioned how does the
Chamber fit in and engage the community to make sure that stay in Tamarac and offer them
help to foster the growth of the business. Commissioner Bolton said he would like to see a
defined role of the Chamber. Commissioner Bolton said the Chamber needs to do a better
job and wants to see No. Lauderdale take more responsibility for this event. The Taste of
Tamarac is a great event and does not want to see it die. Mayor Gomez said sometimes in a
relationship, responsibilities vary; the Taste of Tamarac is a Tamarac event and there are No.
Lauderdale events that Tamarac will be doing. Commissioner Fishman seconded by Vice
Mayor Placko moved approval of TR13313. Motion passed unanimously (5-0).
d. TR13313 - 2019 Chamber of Commerce Taste of Tamarac: A Resolution of the City
Commission of the City of Tamarac, Florida, approving a request from the Tamarac/North
Lauderdale Chamber of Commerce for in-kind support and to waive fees for Friday, October
11, 2019, and Saturday, October 12, 2019, for the Taste of Tamarac event to be held at the
Tamarac Community Center on Saturday, October 12, 2019, from 11:30 a.m. to 3:00 p.m.;
providing for permits, proper insurance, and execution of a Hold Harmless Agreement;
providing for conflicts; providing for severability; and providing for an effective date.

Commissioner Fishman seconded by Vice Mayor Placko moved approval of getting TR13327
on the table for discussion. City Attorney Goren read TR13327 by title into the record.
Commissioner Bolton said he does not have a specific issue with this but has an issue with
the process and would like more information on the people they are appointing and would like
to see a resume in order to see their qualifications. Commissioner Bolton said he does not
want to appoint someone he knows nothing about and Commissioner Gelin, Mayor Gomez
and Vice Mayor Placko concurred. Commissioner Gelin said staff should make sure a
resume is included in the future so that this does not happen again. City Attorney Goren said
he regrets not including the resume in the backup. City Attorney Goren said there is not a
large pool of individuals that can act as a Red-Light Camera Special Magistrate and they are
limited to perform that function for only one city. City Attorney Goren read parts of Ms. Hue's
resume into the record. Assistant City Attorney Bridgeman, who acts as Tamarac's
Prosecutor, looked at options and she recommended Ms. Hue for the position. Commissioner
Bolton seconded by Commissioner Gelin moved to table this item to the September 11, 2019
meeting so that they can review Ms. Hue's resume and all the information they need to make
the appointment. Motion passed (4-1) with Commissioner Gelin dissenting.
TABLED TO THE SEPTEMBER 11, 2019 COMMISSION MEETING
i. TR13327 - Appointment of a Special Magistrate for Red Light Camera Hearings: A
Resolution of the City Commission of the City of Tamarac appointing Ava-Gaye M. Hue to
serve as Special Magistrate for local Red-Light Camera Hearings; providing for conflicts;
providing for severability and providing for an effective date.

7. REGULAR AGENDA: There were no Regular Agenda items scheduled for this meeting.
8. ORDINANCE(S) - FIRST READING:
111 a. TO2411 - Adjournment of Meeting Ordinance: An Ordinance of the City Commission of the
City of Tamarac, Florida amending Chapter 2, "Administration," Article II, "City Commission,"
of the City of Tamarac Code of Ordinances, by amending Section 2-29, "Regular Meetings";
providing for conflicts; providing for severability; and providing for an effective date.
Commissioner Bolton seconded by Commissioner Gelin made a motion to get this item on
the table for discussion. City Attorney Goren read TO2411 by title into the record.
Commissioner Gelin said he asked for this ordinance because of what happened at the last
meeting where there were a lot of residents who had to leave over the course of the 10-hour
meeting. Other cities have a time certain to end meetings and is recommending ending the
meeting and beginning a new meeting the next day. Commissioner Gelin said he would also
like to see the Commissioner's name that sponsored the item listed on the item. Mayor
Gomez said she was concerned about moving everything to the next regular Commission
Meeting and it should be heard the next day, or as soon as practicable. There was a
discussion on the proper notice requirements for the public to know and be present. City
Attorney Goren said language can be added to the ordinance to give the people the right to
know. Vice Mayor Placko said if they know a meeting is going to be long could we schedule
that for a day meeting and Commissioner Gelin said people work and that will keep people
from attending. Commissioner Fishman said that the Commission normally knows when a
meeting will run long, and it might be good that at the workshop prior to that meeting they can
look at their schedule so that we have some idea a potential date to continue the meeting if
necessary. It was decided to amend the ordinance for second reading to include the following
language: "or to a date and time certain as approved by the majority vote of the city
commission." Commissioner Gelin seconded by Vice Mayor Placko moved approval of
TO2411 on first reading. Motion passed unanimously (5-0).
