CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-2019- /a
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO ACCEPT A
CONTRIBUTION IN AID OF CONSTRUCTION FROM
BUTTERS CONSTRUCTION AND DEVELOPMENT FOR THE
CONSTRUCTION OF THE PROPOSED ROUNDABOUT
LOCATED AT THE INTERSECTION OF MCNAB ROAD AND
HIATUS ROAD IN AN AMOUNT OF $225,000.00;
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Butters Construction and Development ("Developer"), is the developer
of the located on the southwest corner of the intersection of Hiatus Road and
property
McNab Road; and
WHEREAS, the development is anticipated to have an impact on traffic in that
immediate area; and
WHEREAS, the intersection of McNab Road and Hiatus Road does not meet the
minimum criteria for a traffic signal; and
WHEREAS, the City and the Developer agree that the installation of a roundabout/
traffic circle is a cost-effective means to provide traffic calming in that area to manage
traffic flow and reduce the risk of traffic collisions; and
WHEREAS, the Developer has offered to provide a contribution of $225,000.00
towards the construction of the proposed roundabout; and

WHEREAS, the installation of a roundabout at the intersection of North McNab
Road and North Hiatus Road was a condition of the New Development Site Plan for the
proposed Tamarac Exchange Center; and
WHEREAS, the City of Tamarac will provide the design and permitting, in addition to
any construction costs in excess of $225,000.00; and
WHEREAS, the Director of Public Services and the Director of Financial Services
recommend the City accept a contribution in aid of construction costs in the amount of
$225,000.00 for the installation of a roundabout located at the intersection of McNab Road
and Hiatus Road; and
WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in
the best interest of the citizens and residents of the City of Tamarac to authorize the
appropriate City Officials to accept a contribution in aid of construction costs in the amount
of $225,000.00 for the installation of a roundabout located at the intersection of McNab
Road and Hiatus Road.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA, THAT:

SECTION 1 : The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution.
All exhibits attached hereto and referenced herein are incorporated and made a specific
part of this Resolution.
SECTION 2: The appropriate City Officials are HEREBY authorized to accept and
to take all necessary steps to effectuate the receipt of a contribution in the amount of
$225,000.00 from Butters Construction and Development in aid of construction costs for
the installation of a roundabout located at the intersection of McNab Road and Hiatus
Road.
SECTION 3: The City will collect $225,000.00 in contribution charges prior to
issuance of an Infrastructure Engineering Permit for the property at the southwest corner of
McNab Road and Hiatus Road.
SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 5: If any clause, section, other part or application of this Resolution
is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or

application, it shall not affect the validity of the remaining portions or applications of this
Resolution.
SECTION 6: This Resolution shall become effective immediately upon its
passage and adoption.
