R-2019- 16 V A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, RELATING TO THE MEMORANDUM OF UNDERSTANDING REGARDING COLLABORATIVE STUDY AND SUBSEQUENT DEVELOPMENT OF AN INTEGRATED SOLID WASTE AND RECYCLING SYSTEM; APPOINTING REPRESENTATIVES TO REPRESENT THE CITY OF TAMARAC IN MATTERS RELATING TO THE MEMORANDUM OF UNDERSTANDING; PROVIDING DIRECTION ON REPRESENTATION ON THE TECHNICAL GROUP OF THE MEMORANDUM OF UNDERSTANDING; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac entered into the Memorandum of Understanding Regarding Collaborative Study and Subsequent Development of an Integrated Solid Waste Recycling System ("MOU"); and WHEREAS, the MOU provides for the establishment of a Working Group comprised of elected officials from Broward County, and the municipal signatories of the MOU must decide the number of municipal members of the Working Group, how to select them, and who they will be, as well as make other collective decisions on behalf of municipalities as the issues under the MOU are reviewed; and WHEREAS, the MOU also provides for a Technical Group, comprised of staff-level persons to review issues and make recommendations to the Working Group, and any municipality that elects to do so may have a representative on the Working Group; and TR #13365 October 23, 2019 Page 2 of 3 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: The City Commission of the City of Tamarac hereby appoints Mayor Michelle J. Gomez as the City's representative and Vice-Mayor Debra Placko as the City of Tamarac's alternate representative, to vote on behalf of the City of Tamarac on matters relating to the MOU, including decisions regarding the Working Group. The alternate representative will participate and vote only in the absence or unavailability of the representative. SECTION 3: The City Commission of the City of Tamarac hereby determines to appoint a member to the Technical Group of the MOU. Troy Gies is hereby appointed by the City Commission of the City of Tamarac to the Technical Group of the MOU. SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
