RESOLUTION NO. R-2019 I 1 9
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO SELECT, APPROVE
AND AWARD THE ACQUISITION OF TEMPORARY
STAFFING SERVICES ON AN AS-NEEDED BASIS TO
TEMPORARILY FILL BUDGETED EMPLOYEE VACANCIES
FOR PUBLIC SERVICES AND PROVIDE FOR A METHOD
TO STAFF TEMPORARY POSITIONS FOR STORMWATER
AND STREETS DIVISIONS IN AN AMOUNT NOT TO
EXCEED AN AGGREGATE TOTAL OF $210,000.00 FOR
FISCAL YEAR 2020, UTILIZING AGREEMENTS AWARDED
BY THE STATE OF FLORIDA DEPARTMENT OF
MANAGEMENT SERVICES, THE SOUTH FLORIDA
GOVERNMENTAL PURCHASING COOPERATIVE OR
OTHER FORMALLY COMPETED AGREEMENTS BY
OTHER FLORIDA GOVERNMENTAL UNITS, OR
111 NATIONAL PURCHASING COOPERATIVES, AND TO
ESTABLISH A PROCESS FOR ACQUIRING SPECIALIZED
TEMPORARY STAFFING NEEDS, AS WELL AS
ESTABLISHING QUOTATION PROCEDURES WHEN
THERE ARE NO AVAILABLE FIRMS WITH
COMPETITIVELY BID AGREEMENTS, IN THE BEST
INTEREST OF THE CITY ; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the City of Tamarac is responsible for the care, maintenance and
appearance of the canals, waterways, sidewalks, curbs, and medians within its
boundaries; and
WHEREAS, the Public Services Department utilizes temporary labor services that
were needed to provide for continuity of City services for short periods of time for a
seasonal project to provide removal of debris and excess aquatic vegetation from the
City's canals and drainage areas; and

WHEREAS, temporary labor is utilized to improve the appearance of City-owned
sidewalks and medians in the program to pressure wash these areas within the City; and
WHEREAS, temporary labor is utilized to fill budgeted positions during prolonged
absences and hiring processes to ensure provision of essential services; and
WHEREAS, the recruitment of replacement employees is often a long and very
detailed process as a result of considerable competition in the labor market, especially
for some specialized positions; and is often necessary to employ temporary employees
to perform the work of departed budgeted employees until the City is able to conduct and
complete a recruitment effort to replace those positions; and
WHEREAS, temporary employees are utilized to provide temporary assistance
during the recruitment and selection process for budgeted vacant positions; and
WHEREAS, the City may encounter situations when a departmental workload is
temporarily increased due to unanticipated circumstances, or circumstances that are
anticipated to exist for only a short period of time, where it is not prudent to permanently
fund additional positions on a full-time basis; and
WHEREAS, there are several sources for temporary staffing which have been
developed and awarded as a result of a formal competitive public process, including but
not limited to agreements in place with the State of Florida Department of Management
Services, the Southeast Florida Governmental Purchasing Cooperative, as well as with
national purchasing cooperative programs, or other public agencies within the State of
Florida which permit other public entities to piggy-back off of their agreements; and
WHEREAS, City of Tamarac Code, §6-148(d) allows the Purchasing Officer the
authority to waive purchasing procedures and purchase goods and services by

participating agencies under a cooperative purchasing program with other governmental
agencies; and
WHEREAS, City of Tamarac Code, §6-148(f) allows the Purchasing Officer to
waive purchasing procedures and purchase goods and services from contracts awarded
by other Governmental units, including the United States Government or another
governmental or not-for-profit entity, when such contracts were awarded using a formal
competitive process; and
WHEREAS, it has been proven in the marketplace that these bids provide the
lowest prices as well as the most efficient method for acquiring temporary staffing
services; and
WHEREAS, despite the availability of temporary staffing available through these
bids, under certain situations, the City has a need for specialized temporary personnel
due to specific knowledge or technical / specialized skill requirements of the budgeted
vacant position; and
WHEREAS, it is often necessary to use a sole temporary employment agency that
is uniquely capable of supplying specialized personnel with specific knowledge or
technical / specialized skill requirements, and whose services may be obtained through
a sole source determination in accordance with Section 6-148 (b) of the Tamarac
Procurement Code; and
WHEREAS, there may be specific situations where no firms holding competitively
bid agreements or who are considered to be a sole source have available temporary office
staff to meet the City's needs, and adequate competition exists for these required
temporary employees; and

WHEREAS, in the event that no firms holding competitively bid agreements, or
who are eligible for a sole source procurement have available temporary staff capable of
meeting the City's needs, and adequate competition exists in the marketplace, the using
department shall be responsible to obtain competitive quotations in accordance with the
requirements of Section 6-147 of the Tamarac Procurement Code with the covenant that
any such requirements in excess of$65,000.00 shall be competitively bid; and,
WHEREAS, the Director of Public Services, Director of Financial Services, and
Purchasing and Contracts Manager have determined that it is in the City's best interest
to authorize the annual expenditure not to exceed $210,000.00 for temporary staffing
services to fill temporary budgeted employee vacancies for the Public Services
Department; and
WHEREAS, it is in the best interest of the City to authorize the appropriate City
officials to select, approve and award temporary staffing services up to an aggregate limit
of $210,000.00 to a contractor providing the most cost effective agreement, taking into
consideration any special need for specialized skills and knowledge, utilizing a State of
Florida Agreement, an Agreement issued through the Southeast Florida Governmental
Purchasing Cooperative, an Agreement issued by a national purchasing cooperative
group, or a competitively awarded agreement available for piggy-backing from another
Governmental entity or a not-for-profit agency when such agreements are awarded
pursuant to a formal competitive process by the United States Government, a
governmental agency in the State for Florida, or from a not-for-profit entity, or other
available contractors who do not hold any such agreement as necessary through the use
of written quotations conducted in accordance with Section 6-147 (e) of the Tamarac

Procurement Code, or through a sole source justification in accordance with Section 6-
148 (b) of the Tamarac Procurement Code, when appropriate, whichever is in the best
interest of City; and
WHEREAS, the City Commission of the City of Tamarac deems it to be in the City's
best interest to authorize the appropriate City Officials to select, approve and award
temporary staffing services on an as-needed basis in an aggregate amount not to exceed
$210,000.00 for Fiscal Year 2020 to a contractor(s) providing the most cost effective
agreement, taking into consideration any special need for specialized skills and
knowledge, utilizing a State of Florida Agreement, an Agreement issued through the
Southeast Florida Governmental Purchasing Cooperative, an Agreement issued by a
national purchasing cooperative group, or a competitively awarded agreement available
for piggy-backing from another Governmental entity or a not-for-profit agency when such
agreements are awarded pursuant to a formal competitive process by the United States
Government, an governmental agency in the State for Florida, or from a not-for-profit
entity, or other available contractors who do not hold any such agreement as necessary
through the use of written quotations conducted in accordance with Section 6-147 (e) of
the Tamarac Procurement Code, or through a sole source justification in accordance with
Section 6-148 (b) of the Tamarac Procurement Code, when appropriate, whichever is in
the best interest of City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA THAT:

SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution
upon adoption hereof. All Exhibits attached hereto are incorporated herein and made a
specific part of this resolution.
SECTION 2: The appropriate City Officials are authorized to select,
approve and award temporary staffing services on an as-needed basis to temporarily fill
vacant budgeted City positions, and to provide for temporary staffing for Stormwater and
Streets Divisions, in an aggregate amount not to exceed $210,000.00 for Fiscal Year
2020 to a contractor(s) providing the most cost-effective agreement, taking into
consideration any special need for specialized skills and knowledge, utilizing a State of
Florida Agreement, an Agreement issued through the Southeast Florida Governmental
Purchasing Cooperative, an Agreement issued by a national purchasing cooperative
group, or a competitively awarded agreement available for piggy-backing from another
Governmental entity or a not-for-profit agency when such agreements are awarded
pursuant to a formal competitive process by the United States Government, an
governmental agency in the State for Florida, or from a not-for-profit entity, or other
available contractors who do not hold any such agreement as necessary through the use
of written quotations, or through a sole source justification when appropriate, or other
available contractors who do not hold any such agreement as necessary through the use
of written quotations conducted in accordance with Section 6-147 (e) of the Tamarac
Procurement Code, or through a sole source justification in accordance with Section 6-
148 (b) of the Tamarac Procurement Code, when appropriate, whichever is in the best
interest of City.

SECTION 3: All Resolutions or parts of Resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4: If any provision of this Resolution or the application thereof to
any person or circumstance is held invalid, such invalidity shall not affect other provisions
or applications of this Resolution that can be given effect without the invalid provision or
application, and to this end the provisions of this Resolution are declared to be severable.
SECTION 5: This Resolution shall become effective immediately upon its
passage and adoption.
