CITY COMMISSION MEETING
WEDNESDAY, SEPTEMBER 11, 2019
CALL TO ORDER: Mayor Gomez called the Commission Meeting of the City of Tamarac to
order at 7:03 p.m. on Wednesday, September 11 , 2019, in City Commission Chambers,
Tamarac City Hall, 7525 NW 88th Avenue, Tamarac, FL 33321.
ROLL CALL: Mayor Michelle J. Gomez, Vice Mayor Debra Placko, Commissioner Marlon
Bolton, Commissioner Mike Gelin (via Telephone) and Commissioner Julie Fishman were in
attendance.
Also in attendance were City Manager Michael Cernech, City Attorney Samuel S. Goren and
City Clerk Patricia A. Teufel.

Mayor Gomez asked for a moment of silence in remembrance of the 18th Anniversary of

a. Commissioner Bolton: Commissioner Bolton thanked everyone who was in attendance at
tonight's meeting. Commissioner Bolton recognized Broward County Commissioner Udine
and Vice Mayor Holness. Commissioner Bolton said he would forego his report tonight and

b. Commissioner Gelin: Commissioner Gelin had no report and also recognized Broward
County Commissioner Udine and Vice Mayor Holness.
c. Commissioner Fishman: Commissioner Fishman said she would forego her report tonight.
d. Vice Mayor Placko: Vice Mayor Placko said she would also forego her report tonight and

recognized Broward County Commissioner Udine and Vice Mayor Holness.
e. Mayor Gomez: Mayor Gomez thanked staff for their hard work preparing for Hurricane
Dorian and for the people who had donated items for the relief effort in the Bahamas. Mayor
Gomez noted that today is a special day, it is Patriot's Day.
3. CITY ATTORNEY REPORT: City Attorney Goren had no report
4. CITY MANAGER REPORT: City Manager Cernech welcomed Broward County Vice Mayor
Holness, Commissioner Michael Udine, former Tamarac Mayor Beth Talabisco and School
Board Member Lori Alhadeff.
Upcoming Events: The Community Garage Sale will take place on Saturday, September 14th
from 7:30 a.m. to noon at Tamarac Park. The Rock N' Ride event will take place on Saturday,
September 21st from 4 — 7 p.m. at the Tamarac Sports Complex and will feature music by
"Solid Brass" and a car show.
Public Services has announced that the West Side Water Distribution System serving the
City of Tamarac will temporarily return to Free Chlorination of the drinking water from
Tuesday, September 17, 2019 through Tuesday, October 8, 2019.This only includes
Tamarac's system which provides water to all areas west of State Road 7/US 441 and not Ft.
Lauderdale's system which serves parts of Tamarac east of NW 31st St. These temporary
conditions will not cause adverse health effects, but during this period, some individuals may
experience a slight change in taste or odor in the tap water. This preventative procedure is a
routine part of water distribution system maintenance.
City Manager Cernech said the he was offered the City Manager position in Delray and he
turned that job down and will be remaining with the City of Tamarac.
Mayor Gomez moved out of the order of the agenda to take up Item 6 (f) on the Consent
Agenda, TR13331 — ILA with Broward County Property Acquisition and Exchange.
f. TR13331 - ILA with Broward County Property Acquisition and Exchange: A Resolution of
the City Commission of the City of Tamarac approving an Interlocal Agreement with Broward
County providing for the acceptance of the Assignment of the Purchase Right for the property
known as the "Aitken Property" from Broward County pursuant to the Contract for Sale and
Purchase of the Aitken Property, the exchange of the Aitken Property for the property known
as "the West Lake Park Property," and the Lease of the West Lake Park Property to Broward
County; providing for terms and conditions for the Assignment of the Right to Purchase the
Aitken Property, the exchange of the Aitken Property for the West Lake Park Property, and
the Lease of the West Lake Park Property with Broward County; authorizing the Mayor and
City Manager to take all actions consistent with this Resolution, including the execution of any
and all documents necessary to accept the assignment and purchase of the Aitken Property,
including the Closing Statement and related documents necessary for closing; authorizing the

Mayor and City Manager to take all actions consistent with this Resolution, including the
execution of any and all documents necessary to convey the Aitken Property to Broward
County including the Deed, Closing Statement, and any documents necessary for closing;

including the execution of any and all documents necessary to accept the conveyance of the
West Lake Park Property from Broward County, including the Closing Statement, and any
documents necessary for closing, including an Easement in favor of Broward County and the
public over the access road portion of the West Lake Park Property; authorizing the Mayor
and City Manager to sign the Lease of the West Lake Park Property with Broward County
and to take all actions consistent with this Resolution; providing for conflicts; providing for
severability; and providing for an effective date. City Attorney Goren said this item is open for
public comment and read TR13331 by title into the record. City Attorney Goren said there are
documents in your books that refer to this item. City Attorney Goren said Assistant County
Administrator Alfonso Jefferson, Broward County Vice Mayor Holness, Commissioner
Michael Udine and Deputy County Attorney Annika Ashton are in attendance. Commissioner
Bolton seconded by Vice Mayor Placko made a motion to approve TR13331. Mr. Jefferson
said this is the last piece to get done, all permits and documents are done and they are
waiting for the system to go live very soon. Mr. Jefferson said he is here to answer any
questions the Commission may have. Broward County has been working day and night to get
this done.
Vice Mayor Holness thanked the Commission for moving this item forward and allowing us to
come into Tamarac for the tower site. Staff has been diligent in finding proper sites for the
new towers. Vice Mayor Holness said what Tamarac is doing is facilitating the public safety in
Broward. Vice Mayor Holness thanked the Commission for their forward thinking and
facilitating this to make it happen. Commissioner Udine expressed his thanks for Tamarac
assisting with this critical public safety issue. One year ago, Tamarac agreed to the site
behind BSO and now that site is finished, and it is time to get this system up and running.
Commissioner Udine said the County tried to work with Hollywood and talked about the
negotiation process with Hollywood and this will complete this project. Commissioner Udine
said the Marjory Stoneman Douglas Commission Members Max Schacter and Ryan Petty
are here tonight and have been through all the testimony that went before the Commission.
This is a critical issue and he cannot thank Tamarac enough for working with Broward County
to get this done.
Mr. Max Schachter said he lost his son at Marjory Stoneman Douglas. Mr. Schachter said he
wants to thank Tamarac for doing what Hollywood is not. This radio system is decades old
and failed at the Ft. Lauderdale and Marjory Stoneman Douglas incidents. Mr. Schachter
talked about the system throttling on February 14, 2018 and as a result law enforcement
could not communicate. This is a public safety issue and it will make Broward County safer.
Mr. Ryan Petty lost his daughter Alaina on February 14, 2018 and wanted to add his thanks
for Tamarac taking the lead here. We are asking our first responders to use 30-year old
technology for which we can no longer get spare parts. Mr. Petty thanked the Commission for
their leadership and letting him talk about how important this is for Broward County.
Mayor Gomez opened the Public Hearing and the following individuals spoke in opposition to
the land swap: Karen Caputo, Alex Brown, Hollywood Vice Mayor Traci Callari, Doug Young,
Charlotte Roth, Lisa Stingone, Mark Florio, Gerald Heller. Mr. Ellis Donsky offered up
alternative sites for the tower. Mr. Jefferson talked about working with Hollywood for over
three years, the negotiations, looking at multiple sites for the tower and noted that the

Hollywood Planning Board recommended this site. Mr. Jefferson talked about the different
studies that were done. Mr. Jefferson said they are running out of time and they cannot get
spare parts for the current system and it is time to move forward and finalize this. Broward
County is not hiding and not doing anything backhanded. We initially wanted to have this up
and running by December 2019 and we will not meet that time frame; it will happen sometime
in 2020. Hollywood Commissioner Caryl Shuham was in opposition to the Westlake site and
favored the Circ Hotel site. Broward County Deputy Attorney Annika Ashton addressed some
items that were brought up and clarified that Broward County has the legal right to do the
swap. Vice Mayor Holness said they are elected to represent Broward County residents and
understands people having a problem with this in their backyard and talked about the
meetings they had with Hollywood. Vice Mayor Holness said this swap has to happen as we
need to do what must be done for all the residents of Broward County. All pertinent
information on the speakers is on file in the City Clerk's Office. With no one else wishing to
speak, closed the Public Hearing.
Commissioner Fishman said at Monday's Workshop she asked for a list of cities that have
park land in other cities and Mr. Jefferson responded that he did provide that information with
all the land swaps. Commissioner Fishman clarified that she wanted a list of similar deals to
the one that you are asking Tamarac to do. Ms. Ashton said they did not have any similar
transactions. Ms. Ashton and Mr. Jefferson responded to questions from Commissioner
Fishman about the location of the land in Westlake Park and concerns should the tower fall.
Mayor Gomez recessed the meeting at 8:59 p.m. and reconvened the meeting at 9:12 with all
present as before.
Commissioner Fishman again expressed her concern about Tamarac's liability if something
should happen with the tower and Ms. Ashton said the County would be contractually liable.
Ms. Ashton and Mr. Jefferson responded to questions from Commissioner Fishman about
multiple sections in the lease. Commissioner Fishman said she does not want to bind future
Commissions by a decision they make now.
Vice Mayor Placko thanked Vice Mayor Holness and Commissioner Udine for coming to the
meeting tonight and understands how you feel as we have a tower in our backyard. Vice
Mayor Placko said this is not a good position for Tamarac to be in; however, this is a safety
issue and does not want any child to be in danger again and we need to get this system on
line.
Commissioner Gelin said that on Monday he asked Mr. Jefferson if Broward County owned
any land in Tamarac and could Broward County go to another city to do a land swap. City
Attorney Goren said the issue that was discussed related to the ability of Broward County to
do this transaction with another city and yes, they could. City Manager Cernech said
Broward County does own property in Tamarac and Mr. Jefferson said yes, we could
exchange land here with another city. Commissioner Gelin said he has a problem with the
fact that Broward County can come into Tamarac and swap out property with another city and
believes we have cause to delay voting on this tonight. Commissioner Gelin asked if this land
swap was discussed with Hollywood and Mr. Jefferson said yes. Commissioner Gelin asked if
Hollywood would support the tower at Westlake Park and Mr. Jefferson said they approved
the site plan for this. Commissioner Gelin said he believes that both Broward County and
Hollywood should have done a better job of coming up with a better deal and not finding a
work-around to get the tower and it would appear that Broward County has leverage.

Commissioner Gelin said he wants this tabled for at least 30 days in order for the County and
Hollywood to get a deal done and move forward with this.
Mayor Gomez said Tamarac has 2 regular parcels of land owned by Broward County and
Right-of Ways. Mr. Jefferson said yes. Mayor Gomez thanked everyone from Hollywood
being here tonight and talked about when the tower was put forth for Tamarac. There were
independent reports done for both parties. Mayor Gomez asked if the idea of a swap
involving Tamarac happened and Ms. Ashton responded the ILA was a resolution of the 164
process and Broward would have to go through some type of swap. Hollywood does not have
a swap provision in their Charter. Ms. Ashton said one of the things that was agreed to was
that we would move forward. Broward County had approached a number of cities with this
and Tamarac came in when the reports indicated that Westlake Park was the best site.
Mayor Gomez said this has been going on for a while and it is her understanding that
Hollywood and Broward County will continue talking. It is her opinion that we should approve
this and let them continue to work on this, so we can move forward.
Commissioner Fishman asked when did the RFP for the new system go out and Mr.
Jefferson said 2 years ago. Commissioner Fishman said this is a 30-year old system and the
RFP only went out a couple of years ago. Commissioner Fishman asked how is it Tamarac's
issue that now we are in a hurry to replace this system. Mr. Jefferson gave a brief history of
the system and replacing it with a new system. Commissioner Fishman noted the park owned
by Broward County in Tamarac is Woodmont Park, which is a nature preserve.
Commissioner Fishman said Broward County could decided that Woodmont Park should be
owned by another city and make a land swap and we would be in the same position as
Hollywood and this is an untenable situation. There is a reason why this has to be done and
she does not want Tamarac to be a part of this.
Commissioner Bolton confirmed the Ms. Ashton said the swap has to take place regardless
of Hollywood's position and Ms. Ashton said yes, we would have to do some type of swap
and get some other city involved. Mr. Jefferson responded to questions from Commissioner
Bolton relative to additional sites that have been looked into. Tamarac has demonstrated its
willingness to make sure that public safety is at the forefront and that is why we have a tower
behind City Hall. Commissioner Bolton said he wants people to understand that public safety
is paramount regardless of how we vote tonight, and we should not be painted as
obstructionists of public safety. Vice Mayor Callari said she is disheartened by the actions of
the parties involved. There are two towers in Hollywood and originally the Circ Hotel location
was not an option and it is a better site as it is equal to Westlake Park. Vice Mayor Callari
asked the Commission to give Hollywood and Broward County a chance to partner and
please postpone this decision and be patient as they are diligently working on this.
Commissioner Fishman left the meeting at 10:20 p.m. and returned at 10:23
Ms. Ashton and Mr. Jefferson responded to a few questions about the sites chosen from Vice
Mayor Placko. Commissioner Bolton said he would be amenable to pull this item and table it
and Ms. Ashton said they would like to move forward tonight. Commissioner Gelin seconded
by Commissioner Bolton moved to table the item for 30 days to give the County and
Hollywood to come up with a deal. Motion passed (4-1) with Mayor Gomez dissenting.

5. PUBLIC PARTICIPATION: Mayor Gomez opened Public Participation and the following
individuals spoke: Jill Lewis complained about not getting their water from the City of

Tamarac and the high fees being charged by Ft. Lauderdale. City Manager Cernech
explained that there are actually 3 water service areas in Tamarac. Tamarac provides water
to the area west of 441 and the area east of 441 gets their water from Ft. Lauderdale and
there is a small area that is on the Broward County water system. These were established
long before certain parts of the City were developed. Residents would have to first petition Ft.
Lauderdale to exit their system; however, some water service areas are not eager to give up
customers. It really isn't up to Tamarac about which water system you are on, it depends on
where you live.
Jonnan Amiel and David Rosenzweig also complained about their water bills from Ft.
Lauderdale; Robert Alphonso complained about the 4 Commission Members that bought all
new furniture for their offices and read an article published on Tamarac Talk. Commissioner
Gelin said the article contained some inaccurate statements. He offered to purchase the
furniture on his own and the City Manager said the furniture was 31 years old. Commissioner
Gelin said he did not spend the money for his own personal gain as the furniture belongs to
the City. Commissioner Gelin said we cannot allow Sharon Aaron Baron to make false
statements. Commissioner Bolton said he did not know how much the furniture cost and he
did not get new furniture as he did not want to find himself in trouble. Commissioner Bolton
said this was not discussed in public. Commissioner Bolton said he has dealt with Mr.
Alphonso during the last election when he had an illegal campaign sign on his lawn and
noted that at no time did he use his office to advance anyone in an election and he chose to
endorse someone who could move the City in a positive way. Commissioner Bolton said Mr.
Alphonso addressed the Commission and Mayor in a disrespectful manner and we need to
hold people accountable to the rules of conduct for Commission meetings. William Goffinet
talked about the $700 car allowance the Commission members receive and Wendy Goffinet
said she was opposed to the proposed construction at the Woodlands,

6. CONSENT AGENDA: Mayor Gomez asked City Manager Cernech if there were any
changes/additions to the Consent Agenda and City Manager Cernech said there were no
changes/additions to the Consent Agenda. Commissioner Bolton said the Commission
should have had more information on the appointment of Ava-Gaye M. Hue as Special
Magistrate at the last meeting in order to make an informed decision. Commissioner Gelin
asked Ms. Hue if she was a resident of Tamarac and she replied that she resided in
Plantation. Commissioner Bolton seconded by Commissioner Fishman moved approval of
the Consent Agenda with the exception of 6 (f) TR13331 — ILA with Broward County Property
Acquisition and Exchange. Motion passed unanimously (5-0).
a. TR13333 - Approve Change Order for Additional Costs Above Contingency for WTP Wells
10-13 Project: A Resolution of the City Commission of the City of Tamarac, Florida,
approving Change Order No. 3 to the Agreement with Florida Design Drilling Corporation for
the Water Treatment Plant Raw Wells 10, 11, 12 & 13 Upgrades Project in an amount not to
exceed $95,000.00; authorizing the appropriate City Officials to execute said Change Order;
approving the increase of the project budget by $66,525.89 to a total project budget not to
exceed $1,088,425.89; authorizing an expenditure from the appropriate accounts; authorizing
an appropriation in an amount not to exceed $66,525.89 to fund said project; providing for
conflicts; providing for severability; and providing for an effective date.

b. TR13334 - Award of Public Art Contract to Ray King for Woodspring Suites Easement
Property: A Resolution of the City Commission of the City of Tamarac, Florida, approving the

Public Art proposal and concept by Ray King, attached hereto as Exhibit "A", and execution
of an agreement between the City of Tamarac and artist Ray King, attached hereto as Exhibit
"B" and incorporated herein, to provide a work of art to be placed on the Woodspring Suites
easement property, in the amount of $150,000; providing for conflicts; providing for
severability; and providing an effective date.

c. TR13328 - Approve and Authorize ILA for Keep Broward Adopt-A-Street Program: A
Resolution of the City Commission of the City of Tamarac, Florida; approving the Interlocal
Agreement between the City of Tamarac and Broward County for the Keep Broward Beautiful
Program effective October 1, 2019 through September 30, 2020; authorizing the appropriate
City Officials to execute said ILA; authorizing the proper City Officials to execute subsequent
renewals; providing for conflicts; providing for severability; and providing for an effective date.

8. ORDINANCE(S) - FIRST READING:
a. TO2407 Approve Amendment #2 to the Franchise Agreement with Waste Management
Extending Said Agreement Effective October 1, 2020 through September 30, 2023 An
Ordinance of the City Commission of the City of Tamarac, Florida, approving Agreement
Amendment No. 2 to renew the existing Franchise Agreement for Furnishing Collection and
Disposal of Residential Solid Waste and Recycling, and Commercial Solid Waste Services for
the period effective October 1, 2020 through September 30, 2023; authorizing the appropriate
City Officials to execute the Agreement Amendment No. 2 to the Franchise Agreement with
Waste Management Inc., of Florida and to take action consistent with the intent of this
Ordinance; providing for the ability to revise rates for solid waste and recycling collection and
disposal services through the adoption of a Resolution by the City Commission; providing for
the establishment of the "C.L.E.A.N. Tamarac Program"; providing for imposition of a special
service fee and issuance of credits to address overloaded dumpsters at commercial
properties and ensure the appropriate level of commercial solid waste service; providing for
conflicts; providing for severability; and providing for an effective date.

City Attorney Goren read T02407 by title into the record. Mayor Gomez asked for any
disclosures from the Commission members: Commissioner Fishman said none;
Commissioner Gelin said he met with representatives of Republic Services, Waste
Management and Coastal; Vice Mayor Placko had a conversation with a representative of
Republic Services; Commissioner Bolton had talks with Coastal, Republic Services, Waste
Management and Waste Pro; Mayor Gomez said she has spoken with Coastal, Republic
Services and Waste Management.
Commissioner Gelin recommended that they do not go through with the extension as he
believes we can get competitive quotes. Commissioner Gelin said we should issue an RFP
now no legitimate reason to extend this. Commissioner Bolton said he would like to ask two
representatives of the companies that are here some questions. Joanne Stanley and Michael
Rizopoulous from Republic Services responded to questions from Commissioner Bolton. Phil
Medico from Coastal responded to questions from Commissioner Bolton. Luigi Pace from
Waste Management and Finance Director Mason responded to questions from
Commissioner Bolton. Commissioner Fishman said she did not speak with Waste
Management but did speak to representatives from Republic Services and Coastal.
Commissioner Gelin noted that Waste Pro did express an interest in providing services to
Tamarac if an RFP came out.
Commissioner Bolton said if the wheel is not broken don't fix it and in this case, does not feel
the wheel is broken. When the time comes to go out for a bid we will have to look at different
companies and make a decision. Commissioner Bolton said he wants to protect the costs we
have now and at a later date look at what other companies are offering. Commissioner Bolton
City Attorney Goren and Purchasing/Contracts Manager Glatz responded to additional
questions from Commissioner Gelin
Commissioner Fishman seconded by Vice Mayor Placko moved approval of T02407 on first
reading. Motion passed (4-1) with Commissioner Gelin dissenting.

b. T02410 - Firefighters' Pension Plan Amendment: An Ordinance of the City Commission of
the City of Tamarac, Florida; amending Chapter 16, Pensions and Retirement, Article VI,
Pension Plan; providing for a BACDROP as an optional form of benefit payment; providing for
a savings clause; providing for severability; providing for codification and providing for an
effective date. City Attorney Goren read TO2410 by title into the record. Commissioner Bolton
seconded by Commissioner Fishman moved approval of T02407 on first reading. Motion
passed unanimously (5-0).

c. TO2412 - Amendment to Zoning Code to Allow Medical Marijuana Dispensaries and
Pharmacies Within Certain Zoning Districts in the City An Ordinance of the City Commission
of the City Of Tamarac, Florida amending Chapter 10, Article 3, Section 10-3.2, entitled
"Table of Allowed Uses", of the City of Tamarac Land Development Code, specifically Table
10-3.1, to permit medical marijuana dispensaries and pharmacies within certain zoning
districts; and amending Chapter 10, Article 3, Section 10-3.3 entitled "Use Specific
