RESOLUTION NO. R-2019 ,
A RESOLUTION OF THE CITY OF TAMARAC, FLORIDA,
APPROVING A MEMORANDUM OF UNDERSTANDING
("MOU") REGARDING BROWARD COLLEGE PROVISION
OF WORKFORCE DEVELOPMENT AND SKILLS TRAINING
OPPORTUNITIES IN TAMARAC PUBLIC FACILITIES FOR
THE BENEFIT OF TAMARAC RESIDENTS AND CITY
EMPLOYEES; APPROVING IN-KIND SUPPORT AND TO
WAIVE FEES FOR BROWARD COLLEGE TO HOLD
CLASSES FOR RESIDENTS IN CITY OF TAMARAC
FACILITIES; AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO EXECUTE SAID MOU AND TO TAKE THE
APPROPRIATE STEPS TO EFFECTUATE THE MOU;
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
• WHEREAS, the City of Tamarac is committed to providing economic development
and workforce development educational opportunities for residents, promoting
employment opportunities, economic growth and improved quality of life; and
WHEREAS, Broward College is a public comprehensive state college and a
resource for community development, business and industry that provides higher
education and technical and occupational training for the residents of Broward County;
and
WHEREAS, Broward College wishes to offer on-site in Tamarac the delivery of
skills training certification classes, workshops and entrepreneurial programming for
residents; and
WHEREAS, this Memorandum of Understanding (MOU) will provide a framework
for the staffs of Broward College and City of Tamarac to form a steering committee of
ilocal business and residents to design a curriculum together to be offered in Tamarac;
and

WHEREAS, Broward College will provide educational offerings in Tamarac,
including non-credit certification classes that would be free of charge to residents, and
the City of Tamarac would agree to provide in-kind classroom space and waive fees for
Broward College to utilize our public City facilities for classes and workshop offerings for
residents; and
WHEREAS, a copy of the Broward College MOU is hereto attached as "Exhibit 1";
and
WHEREAS, the Economic Development Manager, the Director of Human
Resources, and the Director of Parks and Recreation recommend the approval of an
MOU with Broward College to provide skills training opportunities for residents and City
employees in Tamarac, a copy of the proposed MOU is hereto attached as "Exhibit 1";
and
•
WHEREAS, the City Commission of the City of Tamarac deems it to be in the best
interest of the citizens and residents of the City of Tamarac to approve said MOU, and to
further authorize the appropriate City Officials to execute said MOU and to take the
appropriate steps to effectuate said MOU.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA,
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution
upon adoption hereof. All Exhibits attached hereto are incorporated herein and made a
specific part hereof. S

SECTION 2: The City Commission HEREBY approves the MOU Regarding
Broward College providing educational offerings in Tamarac for residents, including skills
certification programs free of charge to residents, in City facilities, a copy of the MOU is
hereto attached as "Exhibit 1" and incorporated herein and made a specific part of this
Resolution.
SECTION 3: The appropriate City Officials are HEREBY authorized to
execute said MOU; and further authorized to take the necessary steps to effectuate said
MOU.

SECTION 4: All Resolutions or parts of Resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 5: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid,
in part or application, it shall not affect the validity of the remaining portions or applications
of this Resolution.

SECTION 6: This Resolution shall become effective immediately upon its •

MEMORANDUM OF UNDERSTANDING
This Memorandum of Understanding ("MOU") is entered into as of lai �t 13 2019, between The District
Board of Trustees of Broward College, Florida ("College"), a political subdivision of the State of Florida,
whose principal place of business is 111 East Las Olas Boulevard, Fort Lauderdale, Florida 33301 and The City
of Tamarac ("City", a municipal corporation organized and existing under the laws of the State of Florida, with
a business address of 7525 NW 88th Avenue, Tamarac, Florida 33321, each individually a "Party," and
collectively "Parties."
I. BACKGROUND
This City's mission is to make the City a secure, clean and desirable place to live, work and visit by providing a
continually improving wide range of city services; to encourage a community that retains and promotes
employment opportunities, economic growth and improved quality of life, where people of diverse cultural
backgrounds and incomes peacefully interrelate.
The College provides higher education and technical and occupational training for the residents of Broward
County. As the first public higher education institution in the county, the College functions as the principal
provider of undergraduate higher education for the residents of Broward County. Where appropriate, these
programs are articulated with the public school system, area vocational schools, and upper-level institutions to
ensure that students can move smoothly from one system to another.
Serving as the principal entry level institution for higher education in its district, the College is also a source of
cultural enrichment; a resource for community development, business, and industry; and an avenue for
continued skill upgrading and enhancement, and retraining. As a public comprehensive state college, the
College serves as a significant leader of America's effort to enhance higher education.
II. PURPOSE
The College and the City enter into this MOU for the purpose of establishing a framework for a relationship
under which the College and the City will cooperate in the areas mutually beneficial to both Parties.
III. GENERAL TERMS
This MOU does not obligate the College or the City to any expenditure of funds. The duration of this MOU is
two (2) years from the date of signing. It may be renewed for an additional two (2) years by written mutual
consent by the Parties with the same formality herewith. Each Party may withdraw from this agreement by
providing sixty(60) days written notice to the other party.
The Parties shall be considered independent contractors and nothing contained herein shall be interpreted to
establish any relationship other than that of an independent contractor between the Parties and their respective
employees, agents, subcontractors or assigns, during or after the term of the MOU. Both Parties are free to
enter into agreements with other Parties for similar services.
The Parties to this MOU shall not discriminate against any employee or participant regarding responsibilities
and obligations under this MOU because of race, age, religion, color, gender, national origin, marital status,

• disability, sexual orientation or any other basis prohibited by law. Nor shall the Parties deny participation in or
benefits arising out of this MOU to any student, employee or participant or otherwise subject anyone to
discrimination in any activity hereunder. The Parties shall take all measures necessary to effectuate these
assurances. Each Party shall comply with all applicable federal and state laws, codes, rules and regulations in
performing its duties, responsibilities and obligations pursuant to this MOU.
IV. SCOPE
The goal of this MOU is to connect business and industry to education. The areas of cooperation may include,
but will not be limited to the following:
1. Design and deliver Broward College on-site workshops, courses and programs for Tamarac citizens as
outlined in Appendix A;
2. Deliver certification training at City locations aligned to employment within the City;
3. Develop guidelines to enable access for City employees and City citizens to be mutually identified by
the parties at a later date to Broward College for degrees and certifications as outlined in Appendix A;
4. Explore the possibility of developing an articulation agreement with Broward County Public Schools
related to Tamarac school students, in grades 6-12, who are studying in the fields of science, technology,
engineering, and math ("STEM") and other fields as outlined in Appendix A;
5. Build a college and career readiness campaign for City of Tamarac residents and employees; and
6. Create entrepreneurial programming available to City of Tamarac residents as outlined in Appendix A.
V. THE COLLEGE'S RESPONSIBILITIES
Provide a single point of contact for connecting the City of Tamarac to the capabilities outlined above and in
Appendix A.
VI. THE CITY'S'S RESPONSIBILITIES
I. Provide a single point of contact for connecting the Broward College to the capabilities outlined above and in
Appendix A.
2. The City agrees to provide facilities to the College to facilitate higher education and technical and
occupational training to City residents, at no cost to the College.
VII. PUBLIC RECORDS
In order to comply with Florida's Public Records Act ("Act"), Chapter 119, Florida Statutes, and pursuant
specifically to section 119.0701, Florida Statutes, the Parties shall:
1. Keep and maintain public records that ordinarily and necessarily would be required by each Party in
order to perform the services under the Agreement.
2. Provide access to the other Party for public records on the same terms and conditions that each Party
would provide the records and at a cost that does not exceed the cost provided in Chapter 119, Florida
• Statutes, or as otherwise provided by law.

• 3. Ensure that public records that are exempt or confidential and exempt from public records disclosure
requirements are not disclosed except as authorized by law.
4. Meet all requirements for retaining public records and transfer, at no cost, to the other Party all public
records in its possession upon termination of the Agreement and destroy any duplicate public records
that are exempt or confidential and exempt from public records disclosure requirements. All records
stored electronically must be provided to in a format that is compatible with the information technology
systems of the other Parry.
5. Meet all requirements for retaining public records and transfer, at no cost, to the other Party all public
records in its possession upon termination of the Agreement and destroy any duplicate public records
that are exempt or confidential and exempt from public records disclosure requirements. All records
stored electronically must be provided in a format that is compatible with the information technology
systems of the other Party.
6. If either Party does not comply with a public records request, the other Party may terminate this
Agreement.
7. IF THE COLLEGE HAS QUESTIONS REGARDING THE APPLICATION OF CHAPTER
119, FLORIDA STATUTES, TO THE COLLEGE'S DUTY TO PROVIDE PUBLIC

•VIII. The City will be responsible for any of their negligent acts, errors, or omissions and the College will be
responsible for any of their negligent acts, errors, or omissions, subject to the rights or limits to liability existing
under Section 768.28, Florida Statutes or beyond that is provided by applicable law.
IX. GENERAL INSURANCE REQUIREMENTS. College shall provide the City with proof that the
College is self-insured for General Liability, Professional Liability, and Workers' Compensation insurance
coverage.
X. MISCELLANEOUS
1. This MOU contains the entire understanding of the Parties relating to the subject matter
superseding all prior communication between the parties whether oral or written.
2 This MOU may not be altered, amended, modified or otherwise changed nor may any of its
terms be waived, except by a written instrument executed by both Parties.
3 The failure of a party to seek redress for violation of or to insist on strict performance of any of
the covenants of this Agreement shall be construed as a wavier or relinquishment for the future of any
covenant, term, condition or election but the same shall continue and remain in full force and effect.
4 This MOU constitutes the complete understanding of the parties for services and shall be
governed by the laws of the State of Florida as now and hereinafter in force. The venue for actions
• arising out of this MOU is fixed in Broward County, Florida.

Broward College and City of Tamarac
Purpose and Scope
To connect City of Tamarac residents and employees to educational opportunities, Broward College and the
City of Tamarac have outlined areas of cooperation that may include, but not be limited to the following:
1. Design and deliver City of Tamarac workshops on college and careers for residents including but not
limited to the following areas:
a. Funding for College
i. FAFSA Workshops
ii. Scholarship Search
iii. Work/School/Life Balance
b. Career Exploration and Development
i. Careers for the New Economy
ii. Picking a Major to Meet your Needs
c. College Readiness
i. On-Line Student Strategies
