R- 2019 /4 3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING THE PURCHASE OF NEW AND REPLACEMENT VEHICLES UTILIZING COMPETITIVE PROCUREMENT METHODS AND CURRENT AGREEMENTS AVAILABLE FOR COOPERATIVE PURCHASE AT THE TIME OF PURCHASE, INCLUDING, BUT NOT LIMITED TO, THE AGREEMENT AWARDED BY THE FLORIDA SHERIFF'S ASSOCIATION, HGAC NATIONAL CONSORTIUM AGREEMENT, AND REV TECHNICAL CENTER; AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO SELECT, APPROVE, AND AWARD THE PURCHASE OF SAID VEHICLES UTILIZING CURRENT AGREEMENTS AVAILABLE FOR COOPERATIVE PURCHASE AT THE TIME OF PURCHASE IN THE BEST INTEREST OF THE CITY; AUTHORIZING AN EXPENDITURE IN AN AMOUNT NOT TO EXCEED $1,323,678 FROM THE APPROPRIATE ACCOUNTS FOR ALL VEHICLES; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, funds were appropriated in the Adopted Fiscal Year 2020 Budget for the purchase of new and replacement vehicles; and WHEREAS, the timely replacement of City vehicles is necessary in order to ensure the effective and efficient delivery of services by City departments; and WHEREAS, City of Tamarac Code, §6-148 allows the Purchasing Officer the authority to waive purchasing procedures and purchase vehicles which is the subject of contracts with other governmental agencies; and WHEREAS, it has been proven in the marketplace that formal competitive bids available for cooperative purchase provide the lowest prices as well as the most efficient method for purchasing vehicles; and WHEREAS, the Director of Public Services, Director of Financial Services, and Purchasing and Contracts Manager have determined that it is in the City's economic Temp. Reso. #13373 December 11, 2019 Page 2 of 5 interests to purchase new and replacement vehicles as identified in Exhibit "1", respectively, attached hereto, utilizing current agreements available for cooperative purchase including, but not limited to, the Agreement awarded by the Florida Sheriffs Association, HGAC National Consortium Agreement, and REV Technical Center; copies of the Agreements are incorporated herein by reference and on file in the office of the City Clerk; and WHEREAS, funds for the Vehicle Purchase Programs, in the amount of $1,323,678 exist in the FY 2020 Adopted Budget in the Asset Maintenance Program, a detailed budget summary is hereto attached as "Exhibit 2"; and WHEREAS, funds for the purchase of new and replacement vehicles, in the amount of $55,000 in the Stormwater Fund, $68,000 in the Facilities Fund, $740,938 in the Fire Rescue Fund, $39,240 in the Building Fund, $175,500 in the Utilities Fund, and $245,000 in the Machinery & Equipment $1,000 or Greater for the purchase of new and replacement vehicles not to exceed a combined total of $1,323,678; a detailed budget summary is hereto attached as "Exhibit 2"; and WHEREAS, it is in the best interest of the City to authorize the appropriate City officials to select, approve, and award the most cost-effective procurement method utilizing competitive procurement methods and current agreements available for cooperative purchase at the time of purchase including, but not limited to, the Agreement awarded by the Florida Sheriff's Association, HGAC National Consortium Agreement and REV Technical Center; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac that the appropriate City Officials be authorized to select, approve and award the cost-effective choice for new Temp. Reso. #13373 December 11, 2019 Page 3 of 5 and replacement vehicles as identified in "Exhibit 1" and "Exhibit 2" be purchased utilizing competitive procurement methods and current agreements available for cooperative purchase, including, but not limited to, the Agreement awarded by the Florida Sheriffs Association, HGAC National Consortium Agreement, and REV Technical Center, in the best interest of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS"clauses are HEREBY ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof and all exhibits referenced and attached hereto are incorporated herein and made a specific part of this Resolution. SECTION 2: The City Commission of the City of Tamarac authorizes the purchase of new and replacement vehicles utilizing competitive procurement methods and current agreements available for cooperative purchase, at the time of purchase, including, but not limited to, the Agreement awarded by the Florida Sheriffs Association, HGAC National Consortium Agreement, and REV Technical Center; authorizing an expenditure in an amount not to exceed $1,323,678 from the appropriate accounts for all vehicles. The appropriate City Officials are further authorized to execute all appropriate agreements and do all things necessary to effectuate this Resolution. SECTION 3: Funds totaling $1,323,678 were appropriated in the Adopted Fiscal Year 2020 Budget for the purchase of new and replacement vehicles as identified in "Exhibit 1" and "Exhibit 2", respectively. Temp. Reso. #13373 December 11, 2019 Page 4 of 5 SECTION 4: An expenditure in the amount of $1,323,678 for said purpose is hereby authorized. SECTION 5: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
