Gomez called the Commission Meeting of the City of Tamarac to order at 7:03 p.m. on Wednesday, November 13, 2019, in the City Commission Chambers, Tamarac City Hall, 7525 NW 88th Avenue, Tamarac FL 33321. ROLL CALL: Mayor Michelle J. Gomez, Vice Mayor Debra Placko, Commissioner Marlon Bolton, Commissioner E. Mike Gelin and Commissioner Julie Fishman were in attendance. Also in attendance were City Manager Michael C. Cernech, Assistant City Attorney Shanna Bridgeman and Acting City Clerk Lillian Pabon. PLEDGE OF ALLEGIANCE: Commissioner Julie Fishman 1. CITY COMMISSION REPORTS a. Commissioner Bolton talked about the Charitable Contribution Organizations, his favorite Charity, Hurricane Dorian hit to the Bahamas, Boyd Anderson High School in Lauderdale Lakes, the City's investment on the children attending school, Woodlands, noted 92% graduation rate and mentioned aviation and culinary classes. Commissioner Bolton thanked the Bermuda Club and concluded his report with his contact information: cell number (954) 275-3850 and www.facebook.com/CommissionerMarlonBolton. b. Commissioner Gelin gave a presentation which is on file at the City Clerk's Office, that covered the bio of George Allen and examples of his legacy. Talked about City Page 1 of 11 CITY COMMISSION MEETING November 13, 2019 Government Week, Broward NAACP, Tamarac Halloween Hoopla, Caribbean American Club Luncheon, Hispanic Vote Event, National Entrepreneur Month Celebration, and the Veterans' Day Celebration. Commissioner Gelin requested a consensus to have City Manager develop legislation for Small Businesses. Mayor Gomez called for a consensus and a consensus was reached 5-0 votes. c. Commissioner Fishman: Would like everyone to save the date as the City of Tamarac will be hosting a Human Trafficking Summit to educate young people on the signs of trafficking and on what to watch out for, to keep children safe. The second track of the Summit will teach the parents what they should look out for, because sometimes kids are not paying attention to those signs. The Summit will be on January 11, 2020 which is also Human Trafficking Awareness Day and information will be sent out shortly. Commissioner Fishman commended Handy, Inc. for the vision shared with her and the work they do keeping people off the streets, so they do not become victims. Commissioner Gelin left the meeting at 7:35 p.m. d. Vice Mayor Placko talked about the organizations that came in today. Commissioner Bolton and her visit to an organization was beyond her expectations as the work this organization does. The organization takes people in, put them through programs, treat them with the highest respect, helping to make productive citizens. She served lunch along with Commissioner Bolton and took a tour of the facility. These people are like all of us that fall in on hard times. She attended the Tamarac Chamber of Commerce's breakfast and met Lydia Cox-Creary from Boyd Anderson High School. Vice Mayor Placko exhorted the public to support kids attending the Boyd Anderson High School as they are the next generation and commended Ms. Cox-Creary for her dedication and the job she does on behalf of the school and children. She talked about the Veteran's Day Ceremony and invited people to contact her office for flyers regarding Veterans' benefits. There are several businesses in Tamarac that give grants to Veterans. Vice Mayor Placko noted the University Hospital now has a second robot, a MAKO, having a total of two (2) robots for doing surgery. She wished a Happy Thanksgiving to all. e. Mayor Gomez thanked the Charity Organizations and talked about the Boyd Anderson High School students in the Culinary Arts. Thanked the Chamber of Commerce for the Golf Tournament that donated to the United Way Campaign. She thanked the Renaissance Charter School Kindergarten children for allowing to read books to them and thanked the Parks & Recreation and the Public Works staff for their hard work and dedication. She talked about the Parks & Recreation Mayor Chess Challenge. Mayor Gomez thanked the Veterans and their families for their service and talked about a brief discussion held about being able to support businesses that hire Veterans and all businesses that raise money to help our Veterans returning home re-enter the civilian world. Mayor Gomez said she looks forward to seeing you all at the Turkey Trot Race. 3. CITY ATTORNEY REPORT: Assistant City Attorney Shana Bridgeman said this is a full circle moment for her as she was a graduate at Boyd Anderson High School, in the IV Program and an IV Diploma recipient. It was quite a surprise to see them here tonight. Page 2 of 11 CITY COMMISSION MEETING November 13, 2019 Assistant City Attorney Bridgeman said City Attorney Sam S. Goren had her attend this meeting and sent his regards. 4. CITY MANAGER REPORT: City Manager Cernech asked to join him in congratulating Assistant Fire Marshall, Tommy Demopoulos as he was appointed as the Southeast Regional director of the Florida Fire Marshalls and Inspectors Association which covers Indian River South to Key West. Tommy Demopoulos is one of six (6) Regional Directors in the State. In this role, Tommy Demopoulos will develop and promote Fire Safety Code Changes, Schedule Training for Fire Investigators, Inspectors and Marshalls in the Southeast, supporting initiatives for both Residents and Firefighters. Financial Services Department was awarded the Certificate of Achievement for Excellence in Financial Reporting by the Government Finance Officers Association of the United States and Canada for its comprehensive Annual Financial Report for the Fiscal Year that ended September 30, 2018. City Manager Cernech noted this is the 31st year in a row and is the 34th year overall the City has been awarded this prestigious award. The Certificate of Achievement is the highest form of recognition that a City can receive in the area of Governmental Accounting and Financial Reporting. Public Services Department: The City of Tamarac in participation with the Cities of Coconut Creek, Coral Springs, Fort Lauderdale, Lauderdale-by the Sea, Lauderdale Lakes, North Lauderdale, Parkland, and Pompano Beach, provides a series of drop-off events for Household Hazardous Waste Page 3 of 11 CITY COMMISSION MEETING November 13, 2019 (HHW) and old electronics (E-Waste). Residents of Tamarac may dispose of HHW and E-Waste at Drop-off events in each participating City. This program provides Tamarac Residents with a responsible way to recycle or dispose of Household Hazardous Waste (HHW) and Electronic Waste (E-Waste). Type of materials accepted include: Fire Extinguishers, Printers and keyboards, Televisions, Computers, Monitors, Auto Batteries, Cell Phones, Household Cleaners, Lawn and Pool Chemicals, Mercury Thermometers, Rechargeable Batteries, Fluorescent Bulbs, Fuel, Paint, Solvents, Motor Oil, Pesticides, Fertilizers, Etc. Have several new partner cities. North Lauderdale joined the Cooperative last year and in 2019, we welcomed Lauderdale by the Sea and City of Parkland. City Manager Cernech reported that Jeff Cirminallo is now the new BSO Chief. Lieutenant Steve Feeley is leaving on Monday to City of Deerfield Beach and City Manager Cernech wished him the best and noted he is owed a debt of gratitude for his service. City Manager concluded by reporting that on December 7th, 2019 is the ribbon cutting ceremony for Tephford Park. 5. PUBLIC PARTICIPATION: Dr. Marsha Becker, residing at 8258 Cassia Terrace, talked about her accident and asked the City Commission to give her an answer. Gerald Heller, residing at South Hampton, talked about teaching toddlers to swim to prevent tragedies. Tamarac resident Ronald J. Wasserman said Veteran's Day Ceremony was a beautiful event and acknowledged Veterans, talked about cancer and mentioned Alex Trebeck is a pancreatic cancer patient. 6. CONSENT AGENDA: Mayor Gomez asked City Manager Cernech if there are items to be added or deleted or for discussion from the Consent Agenda and having none, Mayor Gomez asked for a motion to approve the Consent Agenda as presented. A motion was made by Vice Mayor Placko and seconded by Commissioner Bolton to approve the Consent Agenda as presented. Motion carried 4-0 votes. a. TR13253 - Sign Easement for FL Turnpike Mast Arm Project-A Resolution of the City Commission of the City of Tamarac, Florida, approving the execution of a Sign Easement with the State of Florida Department of Transportation for the FL Turnpike Directional Sign and Mast Arm Project, located along West Commercial Blvd west of NW 47th Terrace authorizing the appropriate City Officials to execute said Sign Easement with the State of Florida Department of Transportation, for the FL Turnpike Directional Sign and Mast Arm Project, located along West Commercial Blvd west of NW 47th Terrace; authorizing and directing the City Clerk to record said Document in the Public Records of Broward County; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2019-121 e. TR13358 - Tamarac Exchange Blanket Public Safety Ingress/Egress Easement - A Resolution of the City Commission of the City of Tamarac, Florida, accepting a Blanket Public Safety Ingress/Egress Easement with Tamarac Industrial Venture, Inc., for the Tamarac Exchange Project, located at 6899 Hiatus Road, to provide proper access to the property for municipal services such as utility, canal, fire and police protection, emergency medical and other public safety services; authorizing the appropriate City Officials to execute said Easement; authorizing and directing the City Clerk to record said Document in the Public Records of Broward County; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2019-122 f. TR13360 - Broward Tree Trust Fund Acceptance - A Resolution of the City Commission of the City of Tamarac, Florida, accepting a grant award in the amount up to $12,188.00 from the Broward County Tree Preservation Trust Fund; authorizing the appropriate City Officials to execute an agreement and necessary documents between the City of Tamarac and Broward County for the Tree Preservation Grant funds; authorizing budget amendments as needed for proper accounting purposes; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2019-123 g. TR13362 - FY20 Wastewater Pump Purchase - A Resolution of the City Commission of the City of Tamarac, Florida, designating Hydra Service, Inc., as a Sole Source Provider for pumps and appurtenances utilized at sixty-four (64) City wastewater pump stations, and to authorize expenditures for the purchase of pumps and appurtenances from Hydra Service, Inc., for an amount not to exceed $95,000 for Fiscal Year 2020; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2019-124 h. TR13364 -Agreement between Broward County Board of County Commissioners and the City of Tamarac for Grant Funds to Finance Park Improvements at the Swim Central Annex. A Resolution of the City Commission of the City of Tamarac, Florida, approving an agreement between Broward County Board of County Commissioners and the City of Tamarac, Florida, and authorizing the appropriate City Officials to execute the agreement for grant funding in the amount up to but not exceeding, $29,325 from the Park Bond Page 5 of 11 CITY COMMISSION MEETING November 13, 2019 Program; amending the annual grants fund budget of estimated revenues and expenditures in the amount of $29,325; providing for conflicts; providing for severability; and providing for an effective date. RESOLUTION R-2019-125 i. TR13366 - Resolution Urging the Governor and Members of the Legislature to Enact a Temporary Ban on Sales of Vaping Products and to increase the Minimum Vaping Age from 18 to 21. A resolution of the City Commission of the City of Tamarac, Florida, urging the Governor and members of the legislature to enact a temporary ban on sales of vaping products, to increase the minimum legal age to purchase vaping products from 18 to 21, and to declare a public health emergency in the State of Florida related to the use of vaping products; directing the city clerk to transmit a copy of this resolution to the governor, the members of the legislature and the Broward League of Cities; providing for conflicts; providing for severability; and providing an effective date. RESOLUTION R-2019-126 j. TR13368 - Commission District 1 Appointment to the Parks & Recreation Board TR13368 - A Resolution of the City Commission of the City of Tamarac, Florida, appointing one (1) member to the Parks and Recreation Board to serve a term concurrent with the appointing Commission Member or until such time as new appointments are made; providing for conflicts; providing for severability; and providing an effective date. RESOLUTION R-2019-127 k. TR13371 - Resolution Authorizing Eminent Domain Action - A Resolution of the City Commission of the City of Tamarac, Florida, Finding Public Purpose and Necessity to Acquire Fee Simple Title to Certain Parcels of Real Property Owned by Adina Cosmetics, Inc. ("Adina Cosmetics"), And Parastoo Sanjari And Sohrab Sanjari ("Sanjari") Respectively, Located at the Southwest Quadrant of NW 53rd Street and Prospect Road, City of Tamarac and More Particularly Described in Exhibit A and Exhibit B Respectively Attached Hereto, and a Facsimile Copy of Which can be Inspected at the Office of the City Clerk, for the Redevelopment and Use as Public Parks, Recreational Facilities, Parking and/or Open Space; Authorizing the City Attorney to Acquire Said Parcels Through Exercise Of The City's Eminent Domain Authority, Pursuant to Sections 166.401 and 166.411, Florida Statutes; Providing City Manager and City Attorney with the Authority to Retain Outside Eminent Domain Counsel, and Such Other Professional Consultants; and to do all Things Pertinent to Effectuating the Terms of this Resolution; Providing for an Effective Date. RESOLUTION R-2019-128 7. REGULAR AGENDA a. TR13273 - Citywide Security Systems Upgrade (Phase 1) - A Resolution of the City Commission of the City of Tamarac, Florida, awarding RFP 19-20R to Johnson Controls Security Solutions LLC.; authorizing the appropriate City Officials to execute associated contract documents for the Citywide Security Systems Upgrade (Phase 1) in the lump sum amount of$833,814.52, a contingency of$83,382 (10%), will be added to the project account for a total project budget of $917,197; authorizing the City Manager or his Page 6 of 11 CITY COMMISSION MEETING November 13, 2019 designee to make changes and issue change orders in accordance with the thresholds and provisions delineated in Section 6-147(j)(2) of the Tamarac Procurement Code; providing for conflicts; providing for severability; and providing for an effective date. Assistant City Attorney Bridgeman read TR13373 title into the record. Motion to approve TR13373 was made by Commissioner Fishman and seconded by Vice Mayor Placko. Mayor Gomez opened the floor for City Commission discussion and with no requests for discussion, moved to call for a vote. Motion to approve TR13373 passed 4-0 votes. RESOLUTION R-2019-129 8. ORDINANCE(S) - FIRST READING a. TO2420 - Woodlands Overlay District Termination Extension - An ordinance of the City Commission of the City of Tamarac, Florida extending the Woodlands Overlay District termination date nunc pro tunc, by amending Chapter 10 of the City of Tamarac Code of Ordinances, entitled "Land Development Code" by amending Article 2, entitled "Zoning Districts" by specifically amending Section 10-2.7(C), entitled "Woodlands Overlay District", to sunset and terminate the Woodlands Overlay District two years after the effective date of the City of Tamarac Land Development Code, in conformity with the City of Tamarac Comprehensive Plan; providing for codification; providing for conflicts; providing for severability; and providing for an effective date. Assistant City Attorney Bridgeman read T02420 title into the record. Mayor Gomez asked for a motion to approve T02420 which was made by Commissioner Fishman and seconded by Vice Mayor Placko. Mayor Gomez noted a Public Hearing is not required on ordinances for First Reading and opened the floor for City Commission discussion. Commissioner Gelin return to the meeting at 8:04 p.m. Commissioner Bolton asked how many areas of Tamarac have an overlay district. City Manager Cernech responded that there is only one (1). Commissioner Bolton asked why there is only one (1) overlay district in the City. City Manager Cernech noted there is only one overlay district and it is the Woodlands. City Manager Cernech responded to additional questions from the City Commission regarding the termination request. He provided feedback regarding the deed restrictions exposed in 2003 as the reason for the then City Commission to recommend creating an overlay district to protect the deed restrictions. The Overlay District expired on July. The deed restrictions in place need protection and he is recommending the approval to extend it for another year. Motion to approve T02420 carried unanimously (5-0). PASSED ON FIRST READING NOVEMBER 13, 2019 b. TO2421 - Ordinance amending Code to provide Extended Hours Permit from 2:00 am to 4:00 a.m. for sale of alcohol every day of the week. An Ordinance of the City Commission of the City of Tamarac, Florida amending Chapter 3, of the City of Tamarac Code of Ordinances, entitled "Alcoholic Beverages", by specifically amending Section 3- 4 to allow the sale and serving of alcoholic beverages for consumption on-premises only from 2:00 a.m. to 4:00 a.m. everyday subject to Special Extended Hours Permit approval by the City Commission, consistent with the existing, Special Extended Hours Permit application review process; providing for codification; providing for conflicts; providing for Page 7 of 11 CITY COMMISSION MEETING November 13, 2019 severability; and providing for an effective date. Assistant City Attorney Bridgeman read TO2421 title into the record. Mayor Gomez asked for a motion to approve TO2421 as presented. A motion by Commissioner Gelin seconded by Commissioner Fishman was made. Mayor Gomez recognized people in the community that wished to speak, opened a Public Hearing. Marc Louis Jean, residing at 6196 Laurel Lane. He is a business owner that spoke on behalf of business owners present. He noted in addition to be a business owner, he has coached sports in the City for the last eight (8) years, fed the hungry and continue assisting people in need of help. Mr. Jean said he was approached by various business owners regarding the item being heard today, closing at 2:00 a.m. instead of 4:00 a.m. He said other cities offer extended hours for alcohol consumption until 4:00 a.m., and he wants to be able to compete with those businesses and the approval of this item puts him at a disadvantage. Business owner Jean said to have met with Economic Development Manager Lori Funderwhite, Assistant City Manager Kathleen Gunn, City Manager Michael Cernech and Community Development Director Maxine Calloway to talk about how the City is changing. He looked at other cities he may be able to move his business and spoke to Commissioner Campbell in the City of Lauderhill about the issue. City of Tamarac staff did a lot of research and he did not receive feedback that would negatively impact the City and asked the City Commission to approve the item presented as for him is very hard to stay in business. In a City Commission Discussion, Commissioner Bolton asked Business owner Jean questions regarding where the customers are coming from, and the business from 6:00 p.m. to 2:00 a.m. Business owner Jean responded to having customers through Facebook Invites, pick and choose areas, customers from North Lauderdale to South of Commercial Boulevard, from East of 441 and West to the Sawgrass. He tries to offer something different and cooks to order. Customers come in to eat at 6:00 p.m. or attend Happy Hour on Fridays. Commissioner noted he is trying to balance business owners needs with the needs of the residents. Business owner Jean stated he provides taxi service for those who drink, monitors the underage, monitors those with too much to drink. Additional discussion ensued regarding the number of drinks sold. Commissioner Bolton said he wanted to see if renewing annually instead of every three (3) years would work. Community Development Director Calloway responded if this is what the City Commission desires, then yes. She provided an explanation should this ordinance pass. Discussion ensued regarding types of businesses and applicable zoning uses. Director Calloway noted the ordinance relates to onsite consumption only. Mayor Gomez had concerns with the ordinance, but understands what is being asked on behalf of the community. She had heard from residents and other business owners in shopping plazas located next to establishments that sell alcohol. Commissioner Gelin said he trusts the staff to do a good job and they have done their research. There are clubs selling alcohol just down the road from Pine Island and they are opened late into the night. He said not to do anything to negatively impact small businesses. There is no need to change aside from the expert's recommendation. Any special changes must come in front of the City Commission as a Special Exception. Commissioner Fishman said, "we always talk about Tamarac is changing, Tamarac is getting younger, and to try keep businesses here and growing." She noted she does not drink, but does not want to deny others from enjoying one. She agreed with Commissioner Gelin on what the staff brought. Commissioner Fishman agreed with the passing of the ordinance as presented. Vice Mayor Placko stated it was never her intention to hurt businesses. She may approve but not impacting businesses. Page 8 of 11 CITY COMMISSION MEETING November 13, 2019 Mayor Gomez said she would like to see changes made to the ordinance in an attempt to make a compromise as follows: Items 3.4(c) The owner or lessee of an establishment selling and serving alcoholic beverages for on-premises consumption "must" instead of "may", submit an application.... Item 3.4(d) The city commission may approve a special permit for a period of one (1) year... and apply for future years when operating under one- year provisions, and no issues with residents or plaza businesses. Add #5 The ability to hear from the plaza owners and communities around them. Get back to discuss with the Mayor. Mayor Gomez has a question on Section 3.4(e) to discuss at a later time if the ordinance passes First Reading. #4 application for Thursday, Friday and Saturday, three (3) days per week and not seven (7) days per week. She asked if the $500 application fee is in line with other fees. Director Calloway responded the $500 fee is appropriate and the City Commission will be considering an amendment to the fee schedule by Resolution, if the ordinance passes, on the same Agenda. Discussion ensued regarding traffic study and traffic statistics. Commissioner Bolton noted he has taken a conservative approach and agreed with Mayor Gomez recommendation. Motion to approve TO2421 as presented failed 2-3 votes with Commissioner Bolton, Vice Mayor Placko and Mayor Gomez dissenting. Commissioner Bolton made a motion seconded by Vice Mayor Placko to approve TO2421 as amended. TO2421 passed on First Reading as amended 4-1 votes with Commissioner Gelin dissenting. PASSED AS AMENDED ON FIRST READING NOVEMBER 13, 2019 c. TO2419 - Ordinance Raising Age to 21 For Sale or Distribution of Electronic Nicotine Dispensing Devices and Nicotine Products. An ordinance of the City Commission of the City of Tamarac, Florida, amending Chapter 13 of the City's Code of Ordinances, entitled "Miscellaneous Offenses" by specifically creating Section 13-25 entitled "Prohibition of Sale or Distribution of Electronic Nicotine Dispensing Devices and Nicotine Products to Persons Under 21 Years of Age"; to prohibit the sale or distribution of electronic nicotine dispensing devices and nicotine products to persons under 21 years of age; providing for penalties; providing for conflict; providing for severability; providing for codification; and providing for an effective date. Assistant City Attorney Bridgeman read TO2419 title onto the record. Mayor Gomez asked for a motion to approve T02419.
