A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, APPROVING REPLACEMENT
OF CITY OWNED STREET LIGHTS; AUTHORIZING AN
EXPENDITURE OF FUNDS FOR AN AMOUNT NOT TO
EXCEED THE APPROVED ANNUAL BUDGET; UTILIZING
ITB NO. 16-17-029 SOLICITED AND AWARDED BY THE
CITY OF MIAMI GARDENS, FLORIDA, AS THE LEAD
AGENCY FOR THE SOUTHEAST FLORIDA
GOVERNMENTAL PURCHASING COOPERATIVE GROUP;
EFFECTIVE UPON APPROVAL THROUGH NOVEMBER 8,
2020 OR AS EXTENDED BY THE CITY OF MIAMI
GARDENS ON BEHALF OF THE SOUTHEAST FLORIDA
GOVERNMENTAL PURCHASING COOPERATIVE;
AUTHORIZING THE PROPER CITY OFFICIALS TO
EXECUTE CONTRACT RENEWALS; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Tamarac is committed to meeting the Strategic Goal to
provide a Strong Economy in a Healthy Environment through developing environmental
initiatives; and
WHEREAS, the City is continuously seeking opportunities for environmentally
friendly and economically advantageous projects; and
WHEREAS, a need exists to provide services for the proper replacement and
maintenance of City owned street lights for the residents of the City of Tamarac; and
WHEREAS, the City of Tamarac currently utilizes an Interlocal Agreement
between the City of Tamarac and the City of Miami Gardens for the maintenance and
repair of City owned street lights, incorporated herein by reference and on file in the Office

of the City Clerk;
WHEREAS, City staff determined this regional collaborative approach to the
service is economically and logistically advantageous to the City of Tamarac and its
residents; and
WHEREAS, the Southeast Florida Governmental Purchasing Cooperative Group
("Co-op"), through the City of Miami Gardens, via Resolution No. 2017-170-3275 on
November 20, 2017, awarded ITB No. 16-17-029, to Imperial Electric, Inc. currently
effective through November 8, 2020, and will be eligible for three one-year renewals,
copies of ITB No. 16-17-029 and Miami Gardens Resolution No. 2017-170-3275 are
incorporated herein by reference and are on file at the Office of the City Clerk; and
WHEREAS, for the purpose of protecting the health, safety and welfare of the
residents of the Participating Cities, the parties hereto intend by this Agreement to
continue a program for maintenance and repair of City owned street lights; and
WHEREAS, it has been determined that continuing a program using the collective
efforts of the Cities of Tamarac and Miami Gardens ("Participating Cities") is in the best
interest of all the residents of said cities; and
WHEREAS, additional Broward County cities may join the program established by
this Agreement under the same terms and conditions as the Participating Cities; and
WHEREAS, it is the recommendation of the Director of Public Services, the
Financial Services Director, and the Purchasing and Contracts Manager that the City
Commission approve the maintenance and repair of City owned street lights; and that

expenditures for said services per ITB No. 16-17-029 not to exceed the approved budget,
including any approved budget amendments, for said purpose be approved and that the
Appropriate City Officials be authorized to approve and execute any subsequent renewals
to ITB No. 16-17-029; and
WHEREAS, the City Commission of the City of Tamarac deems it to be in the best
interest of the citizens and residents of the City of Tamarac to approve and to authorize
the appropriate City Officials to approve the maintenance and repair of City owned street
lights from Imperial Electric, Inc. and that expenditures for said services per ITB No. 16-
17-029 maintenance and repair of City owned street lights not to exceed the approved
budget, including any approved budget amendments, for said purpose be approved and
that the Appropriate City Officials be authorized to approve and execute any subsequent
renewals to ITB No. 16-17-029.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA THAT:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Resolution
upon adoption hereof. All exhibits attached hereto are incorporated herein and made a
specific part of this resolution.
SECTION 2: The City Commission HEREBY approves the purchase of the

maintenance and repair of City owned street lights from Imperial Electric, Inc., utilizing
ITB No. 16-17-029 solicited and awarded by the City of Miami Gardens, Florida, as the
lead agency for the Southeast Florida Governmental Purchasing Cooperative Group.
SECTION 3: Expenditures for the maintenance and repair of City owned
street lights from Imperial Electric, Inc. per ITB No. 16-17-029, are hereby authorized and
shall not exceed the approved budget including any approved budget amendments.
SECTION 4: The City Manager, or his designee, is hereby authorized to
approve and execute any subsequent renewal options to this Agreement, initiate Change
Orders in amounts not to exceed $65,000 per Section 6-147 of the City Code, and close
the contract award, which includes, but is not limited to, making final payment and
releasing bonds per Section 6-149 of the City Code, when the work has been successfully
completed within the terms, conditions and pricing of the agreement.
SECTION 5: Funding is available for the maintenance and repair of City
owned street lights from the appropriate accounts within the Public Services General
Fund Operating Accounts.
SECTION 6: All resolutions or parts of resolutions in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 7: If any clause, section, other part or application of this
Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid,
in part or application, it shall not affect the validity of the remaining portions or applications
of this Resolution.

SECTION 8: This Resolution shall become effective immediately upon its
passage and adoption. •
