R-2020 - A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING A VACATION OF EASEMENT PETITION TO VACATE A PORTION OF ONE (1) PUBLIC WATER UTILITY EASEMENT LOCATED ON THE SAFEGUARD SELF-STORAGE PROPERTY MORE SPECIFICALLY LOCATED AT 6101 W. COMMERCIAL BOULEVARD AS FURTHER DESCRIBED IN THE LEGAL DESCRIPTION ATTACHED HERETO AS EXHIBIT "A" ; (CASE NO. 2-P-18); PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Dennis Mele, Esq., of Greenspoon Marder, PA designated agent for the property owner, Safeguard Properties, LLC, has requested a Vacation of Easement to vacate a portion of one (1) public water utility easement dedicated by Plat to the City of Tamarac lying in a parcel of land as described in the legal description within the survey attached hereto as (Exhibit "A", incorporated herein and made a specific part thereof); and WHEREAS, the section of the subject Vacation of Easement was previously platted and designated by the single O.R.B and PG: O.R.B. 42994, PG 737; and WHEREAS, the City Engineer has been contacted and has stated no objection to the Vacation of Easement of the utility easement; and WHEREAS, the Director of Community Development recommends approval; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to grant the Vacation of Easement in order to vacate a portion of one (1) public water utility easement dedicated to the City by Plat lying in a parcel of land as described in the legal description within the attached survey (Exhibit"A", attached hereto are incorporated herein and made a specific Temporary Resolution No. 13385 January 23, 2020 Page 2 part thereof); located on a parcel of land located 6101 W. Commercial Boulevard, Tamarac, FL in order to accommodate the Safeguard Self-Storage development. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. All exhibits attached hereto are incorporated herein and made a specific part of this Resolution. SECTION 2: That a portion of the public water utility easement dedicated to the City by Plat, lying in a parcel of land located at 6101 W. Commercial Boulevard, more specifically described in the attached "Exhibit A" IS HEREBY vacated. SECTION 3: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: This Resolution shall become effective immediately upon its adoption.
