R-2020 - L ,;_ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, DELEGATING AUTHORITY TO THE CITY MANAGER TO CANCEL FUTURE COMMISSION MEETINGS DUE TO THE CORONAVIRUS "COVID-19"; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Novel Coronavirus Disease 2019 ("COVID-19") is a severe acute respiratory illness that can spread among humans through respiratory transmission and presents with symptoms similar to those of influenza ; and • WHEREAS, in late 2019, a new and significant outbreak of COVID-19 emerged in China; and WHEREAS, the World Health Organization previously declared COVID-19 a Public Health Emergency of International Concern ; and WHEREAS, in response to the recent COVID-19 outbreak in China, Iran, Italy, Japan, and South Korea, the Centers for Disease Control and Prevention (the "CDC") has deemed it necessary to prohibit or restrict non-essential travel to or from those countries; and • Temp. Reso. 13420 03/19/2020 Page 2 of 4 WHEREAS, on March 2, 2020, Governor DeSantis issued Executive Order41/ 20-51, directing the Florida Department of Health to issue a Public Health Emergency; and WHEREAS, on March 10, 2020, the Broward County Commission authorized the County Administrator to declare a local state of emergency for Broward County due to COVID-19, and she did so that same day and a second declaration on March 17, 2020; and WHEREAS, Article V Sec. 5.04 outlines the powers and duties of the City Manager; and • WHEREAS, on March 13, 2020, the City Manager declared a State of Emergency in the City of Tamarac; and WHEREAS, these powers and duties do not authorize the City Manager to cancel City Commission Meetings; and WHEREAS, the City Commission of the City of Tamarac, deems it to be in the best interests of the citizens and residents of the City of Tamarac to delegate authority temporarily to the City Manager to cancel future City Commission Meetings due to the Novel Coronavirus Disease ("COVID-19"). • Temp. Reso. 13420 03/19/2020 Page 3 of 4 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT: SECTION 1: The foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. SECTION 2: The City Commission hereby delegates authority to the City Manager to cancel future City Commission meetings, due to the Novel Coronavirus Disease ("COVID-19"), until such authority is otherwise revoked by the City Commission. • SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
