ORDINANCE NO. O—oZ 020— E5
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA AMENDING CHAPTER 2, "ADMNISTRATION,"
ARTICLE II, "CITY COMMISSION," OF THE CITY OF TAMARAC
CODE OF ORDINANCES, BY AMENDING SECTION 2-26, "FILING OF
NOTICE OF INTENT TO RUN FOR OFFICE; FILING FEE";
PROVIDING FOR CONFLICTS; PROVIDING FOR CODIFICATION;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City of Tamarac is authorized, by its Home Rule Charter, to enact
municipal laws regarding filing fees for the office of mayor and the office of commissioner;
and
WHEREAS, the twenty-five dollar ($25.00) fee associated with filing a verified notice
of candidacy has not been modified in over forty-five (45) years; and
WHEREAS, in many municipalities in Miami-Dade and Broward Counties, including
the City of Pembroke Pines, the City of Dania Beach, the City of Aventura, the City of North
Miami Beach, the City of Deerfield Beach, and the City of Pompano Beach, the filing fee is
for an amount more than twenty-five dollars ($25.00); and
WHEREAS, the City's filing fees are, in many instances, significantly less than in
other parts of the State of Florida; and
WHEREAS, the City Commission finds that increasing the filing fees for the office of
mayor and the office of commissioner would not only make the City more consistent with
other cities, but will also provide additional needed revenue to offset the costs of the State
mandated electronic filing system for campaign finance reports; and
WHEREAS, the City Commission finds that such an increase in the filing fees for the
office of mayor and the office of commissioner best serves the health, safety and welfare of
the citizens and residents of the City of Tamarac.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA,AS FOLLOWS:
SECTION 1. The foregoing recitals are hereby ratified and confirmed as being true and
correct and are hereby made a specific part of this Ordinance upon adoption hereof.
SECTION 2. The City Commission hereby amends Chapter 2, "Administration," of the
City Code, by amending section 2-26 of Article II, "City Commission"to read as follows:
ARTICLE II. - CITY COMMISSION
Sec. 2-26. - Filing of notice of intent to run for office; filing fee.
Candidates for elected office shall file a timely notice of intention to run for office with
the city clerk on a form provided by the city clerk. Each notice shall be accompanied by a
nonrefundable filing fee. The filing fee for mayor is twenty five seven hundred and fifty
dollars ($25750.00). The filing fee for any other elected city office is ten five hundred dollars
($4-0500.00).
SECTION 3. Conflicts. All Ordinances or parts of Ordinances, Resolutions or parts
thereof in conflict herewith, be and the same are hereby repealed to the extent of such conflict.
SECTION 4. Codification. It is the intention of the City Commission of the City of
Tamarac, Florida that the provisions of this Ordinance shall become and be made a part of the
Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may
be renumbered, re-lettered and the word "Ordinance" may be changed to "Section," "Article" or
such other word or phrase in order to accomplish such intention.
SECTION 5. Severability. Should any section, provision, paragraph, sentence, clause of
word of this Ordinance or portion hereof be held or declared by any court of competent
jurisdiction to be unconstitutional or invalid, in part or application, it shall be considered as
eliminated and shall not affect the validity of the remaining portions or applications of this
Ordinance.

SECTION 6. Effective Date. This Ordinance shall becomee effective upon adoption.
