No. 13374 October 24, 2019 Page 1 of 3 CITY OF TAMARAC, FLORIDA RESOLUTION NO. 2019- / "T A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING THE COMMUNITY DEVELOPMENT DEPARTMENT FEE SCHEDULE, ATTACHED HERETO AS EXHIBIT "A", ADOPTING A FEE FOR "SPECIAL EXTENDED HOURS PERMIT" APPLICATIONS FOR ON-PREMISE CONSUMPTION, ALCOHOLIC BEVERAGE SERVICE; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Land Development Code of the City of Tamarac Code of Ordinances authorizes the City Commission from time to time, to establish by resolution, the amount of application fees; and WHEREAS, Resolution No. R-2018-47, enacted by the City of Tamarac City Commission on May 9, 2018, established the current development review fees that are listed in the Community Development Department Fee Schedule ("Fee Schedule"); and WHEREAS, the City has taken strides to enhance its economic development opportunities, and after outreach from the local business community, has been prompted to amend the Code to allow for on premise consumption, alcoholic beverage sales until 4:00 a.m. on a Thursday, Friday and Saturday; and WHEREAS, the proposed text amendment to include the fee for "Special Extended Hours Permit" applications are not captured in the existing Fee Schedule, thereby necessitating the need for an amendment to the Community Development Department Fee Schedule and; WHEREAS, Staff has reviewed the amended Community Development Fee Schedule and has found the existing $500.00 "Special Extended Hours Permit" application fee to be consistent and comparable with surrounding municipalities; and Temp Reso. No. 13374 October 24, 2019 Page 2 of 3 WHEREAS, the Community Development Director finds the proposed fee supportable and approves the proposed amended Fee Schedule; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to amend the Community Development Department Fee Schedule to reflect the application and $500.00 fee associated with "Special Extended Hours Permit" applications as outlined in Section 3- 4 in the City's Code of Ordinances and not previously reflected in the Fee Schedule. NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. All Exhibits attached hereto are expressly incorporated herein and made a part hereof. SECTION 2: That the Community Development Department Fee Schedule amendment attached hereto as Exhibit "A" and made a part hereof, is hereby approved, to become effective immediately upon adoption. SECTION 3: That all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, or other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or Temp Reso. No. 13374 October 24, 2019 Page 3 of 3 application, it shall not affect the validity of the remaining portions or applications of this Resolution. SECTION 5: This Resolution shall become effective immediately upon its passage and adoption.
