according to the Plat thereof, as recorded in Plat Book 4,
Page 31, and a portion of Parcel A of the Leadership of
Tamarac Phase One Plat, according to the Plat thereof, as
recorded in Plat Book 76, Page 35; all of the public records
of Broward County, Florida.
ORDER APPROVING VARIANCE
The Applicant, Peter Ganci of West Architecture and Design, LLC, designated agent
for the property owner, the City of Tamarac, Florida, (the "Applicant"), filed an application with
the Department of Community Development for the approval of the following Variances:
Variance Request 1: Code Section 11-8 (J) (3)
The Code of Ordinances states: "There shall be a minimum continuous depth of (25 feet) of
landscape area." The petitioner is requesting a minimum of (10 feet) of landscape area for the
side, rear and front landscape buffer areas.
Variance Request 2: Code Section 11-8 (L) (1)
The Code of Ordinances states: "Pedestrian Zone width of 16' (maximum 7' sidewalk within
total area) West, East and North sides of the building." The petitioner is requesting pedestrian
zones less than this on these elevations.

Variance Request 3: Code Section 11-8 (M) (1) (3)
The Code of Ordinances states: "A minimum landscape island of 10' overall width at the
terminus of the parking row by the dumpster." The Petitioner is requesting reducing a portion of
the island to 3'-7" to allow for pedestrian access into the dumpster enclosure.
Variance Request 4: Code Section 24-505
The Code of Ordinances states: "The building setback required is (32') for South property line &
(32') to the North and to the West property line for dumpster enclosure. The petitioner is
requesting a minimum of (10 Feet) of building setback for the front, side and rear to
accommodate the Building Front and the Dumpster side and rear setbacks.
Variance Request 5: Code section 24-507
The Code of Ordinances states: There shall be no parking in the required (25') front, side or rear
setbacks in (I-1) districts. The petitioner is requesting a minimum of (10 feet) of yard to
accommodate the vehicular use areas in the front, side and rear yards, in lieu of, the required (25
feet) setback.
Notice of the request for the Variance was given as required by law. The Planning Board
of the City of Tamarac ("Board") has identified that the property located at 4801 West
Commercial Boulevard, Tamarac, Florida 33319 (the "Properties") are located in the I-1
(Institutional -Educational -Governmental District) Zoning District, and following consideration
of all testimony and evidence presented at the hearing on October 7, 2015 the Board finds as
follows:
1. That special conditions and circumstances exist which are peculiar to the
land, structure, or building involved and which are not applicable to other lands,
structures, or buildings in the same zoning district.
2. That granting the variance requested will not confer on the applicant any
special privilege that is denied by any law or ordinance to other lands, buildings
or structures in the same zoning district.
3. That the requested variance is the minimum variance that will make
possible the reasonable use of the land, structure or building.
5. That the granting of the variance will be in harmony with the general
intent and purpose of the City's Land Development Regulations, and such
variance will not be injurious to the area involved or otherwise detrimental to the
public welfare.
6. The Public Record, including sworn testimony and evidence established
before and presented to the Planning Board on October 7, 2015 is hereby
incorporated by reference and made a part hereof.

Pursuant to the authority contained in Section 24-71 of the City of Tamarac Code of Ordinances,
the Applicant's request for Variance approval as outlined is hereby GRANTED.
This document shall be recorded in the public records of Broward, County, Florida.
